ORDINANCE NO. 13-1396 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING ARTICLE III OF THE CODE OF ORDINANCES <br />ENTITLED "PEDDLERS AND SOLICITORS;" AMENDING <br />DEFINITIONS UNDER SECTION 26.66; AMENDING HOURS OF <br />SOLICITATION; CHANGING THE TERM "OCCUPATIONAL <br />LICENSE" TO "BUSINESS TAX RECEIPTS "; ADDING EXEMPTIONS <br />FROM SOLICITATION PERMIT REQUIREMENTS; AMENDING THE <br />APPLICATION REQUIREMENTS; AMENDING REASONS FOR <br />DENIAL OF A SOLICITATION PERMIT; AMENDING THE FEE <br />REQUIRED TO PROCESS THE APPLICATION; CHANGING THE <br />TIME FRAME FOR EXPIRATION AND RENEWAL OF A <br />SOLICITATION PERMIT; CHANGING THE APPEAL BOARD FOR <br />DENIED OR REVOKED PERMITS TO THE CODE ENFORCEMENT <br />BOARD; AMENDING THE REGULATIONS PERTAINING TO <br />SPONSORS OF JUVENILE SOLICITORS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Casselberry has a particularized, substantial governmental interest in the <br />regulation of door -to -door canvassing where the lawful solicitation of money is involved; and <br />WHEREAS, the City of Casselberry desires to protect its citizens from fraudulent solicitations, crime, <br />and from invasions of privacy; and <br />WHEREAS, the City has previously adopted Chapter 26, Article III, Peddlers and Solicitors, of the <br />Code of Ordinances of the City of Casselberry in order to protect its citizens; and <br />WHEREAS, the City finds that it is more effective to manage a limited term for permits; and <br />WHEREAS, the City has determined that the citizens of Casselberry experience an increased risk of <br />crime after daylight and that limiting solicitation to daylight hours protects their safety; and <br />WHEREAS, the City has determined that limiting the time of solicitation to daylight hours provides <br />law enforcement with a better opportunity to patrol for criminal activity that may occur in the course of <br />solicitation, and therefore, improves health, safety and welfare of the citizens of Casselberry; and <br />WHEREAS, the City has determined that limiting solicitation to the specific period of 9:00 a.m. to <br />7:00 p.m. provides clarity that will result in more consistent enforcement of the regulation than use of a <br />general term, such as "daylight "; and <br />
