Mr. Battistone described the extent of work that had to done on the roof and road conditions. <br />Carlos "Mike" Bauer, Lead Code Compliance officer advised that the cases was brought to the Magistrate on February 12, <br />2015, violations were found, finding of fact was found and the owner of the property was given until July 25, 2016 to <br />correct what the Magistrate found to be in violation. All the City was looking for was the scope of work that was found in <br />violation at that time. The City maintains its position that the $750 assessed, due to just needing a small scope of work to <br />be completed. The work was not completed. <br />Mr. Battistone stated you can't make matters worse and you have to do the job the right way. <br />FINDING OF FACT: The Special Magistrate made a finding based on testimony and evidence. It was found that there <br />was violation entered in February 2015. Based on testimony there is no dispute there was a violation found and an order <br />entered for the property to come into compliance by July 25, 2015. Quite a bit of time was given time was given to get it <br />done and the property didn't come into compliance by that time. The fee was issued, things do happen but the compliance <br />date was not met. There were no facts that would justify reducing he lien amount. The request for reduction of the lien <br />was denied for case # 14- 01314, 480 S Triplet Lake Dr. <br />Disabled/inoperable /unlicensed vehicle(s), ULDR Section 3 -10.9 <br />® CE -11 -01646 2014 Kewannee Trl <br />Nathan Johnson, Code Compliance Officer read the case history, current lien amount: $225, administrative cost and claim: <br />$351.26 (paid) requested reduction amount: fees already paid. Due to when the City filed its lien, the lien is not <br />enforceable against Bank of New York Mellon, TR. The lien may be enforceable against the former owners, Robert and <br />Jeanetta Dibble, should other property be owned in Seminole County in the future. The City requests a Limited Release of <br />the Lien be recorded, releasing Bank of New York Mellon, TR so they may sell the property. There is a pending contract <br />for sale for this property. <br />Swimming pool standards, ULDR Section 3 -10.3 <br />® CE -12 -01814 2014 Kewannee Trl <br />Nathan Johnson, Code Compliance Officer, read the case history, current lien amount: $26,075, administrative cost and <br />claim: $795.78 (paid) requested reduction amount: fees already paid. Due to when the City filed its lien, the lien is not <br />enforceable against Bank of New York Mellon, TR. The lien may be enforceable against the former owners, Robert and <br />Jeanetta Dibble, should other property be owned in Seminole County in the future. The City requests a Limited Release of <br />the Lien be recorded, releasing Bank of New York Mellon, TR so they may sell the property. There is a pending contract <br />for sale for this property. <br />Amber Ashton, representative for the property owner, Bank of New York Mellow as Trustee advised the property is under <br />contract and was supposed to close October 9, 2015. It was understood there are some issues with the property and the <br />buyer is aware and has signed a hold harmless. Ms. Ashton asked that the Special Magistrate agree with the City's request <br />to provide the partial releases of the lien, so the sale can move forward. <br />FINDING OF FACT: The Special Magistrate made a finding based on testimony and evidence. In case # 11- 01646, 2014 <br />Kewannee Trl, the violation was ULDR Section 3 -10.9, lien amount $225. It was ordered that the limited release of lien <br />be recorded. There is a pending sales contract with Bank of New York Mellon as trustee. <br />FINDING OF FACT: The Special Magistrate made a finding based on testimony and evidence. In case # 12- 01814, 2014 <br />Kewannee Trl, the violation was ULDR Section 3 -10.3, lien amount $26,075. It was ordered that the limited release of <br />lien be recorded.
