Planning & Zoning Commission/ <br />Local Planning Agency <br />November 18, 2015 <br />Page 4 <br />An addendum to the staff report was distributed to the Planning and Zoning Commission (a copy is attached <br />and made a part of the minutes). <br />Mr. Cantu said staff requests the Planning and Zoning Commission review the Development of Community <br />Impact application for The Reserve at Legacy Park subdivision (SPR 15 -13) and provide a recommendation of <br />approval to the City Commission. He said this recommendation is based on the revised site plan dated October 12, <br />2015, the findings of fact and conclusions of the information provided in the staff report dated November 18, 2015, <br />and subject to the waivers and conditions outlined in the staff report. <br />Mr. Cantu reviewed the following waivers that were provided in the addendum that was distributed to the <br />Commission at the meeting: <br />a. A waiver from Section 2- 7.26(C)(4)(C)(1) and 2- 7.26(C)(4)(D)(2) for 35 percent open space for <br />individual single family lots. Response: Staff supports the requested waiver based upon the total <br />amount of park land /open space being provided. <br />b. A waiver from Section 2- 7.26(C)(4)(H)(1)(A) for the 20 foot minimum side /corner setback to be 10 <br />foot side /corner, consistent with garden home requirements and the approved site plan. <br />Response: Staff supports the requested side /corner setback waiver based on working with the <br />applicant on increasing trees within landscape buffers. <br />c. A waiver from section 2- 7.26(C)(4)(H)(1)(A) requiring front loaded garages to be at least four (4) <br />feet behind the front building line. The home products to be constructed will be in accordance with <br />the product as presented and agreed upon within the "voluntary development commitment <br />agreement'. Response: Staff supports the requested waiver per the 'Voluntary Development <br />Commitment Agreement'. <br />d. A waiver from section 2- 7.26(C)(4)(H)(1)(A) requiring front loaded garages to be utilized for no <br />more than 50% of the total units. Of that allowed number of front loaded garages, at least 60% of <br />the units must be two story units. The home products to be constructed will be in accordance with <br />the product as presented and agreed upon within the 'Voluntary Development Commitment <br />Agreement'. Response: Staff supports the requested waiver per the 'Voluntary Development <br />Commitment Agreement'. <br />e. A waiver from section 2- 7.26(C)(4)(h)(1)(b) requiring front loaded garages to be at least two (2) feet <br />behind the front building line. The home products to be constructed will be in accordance with the <br />product as presented and agreed upon within the `voluntary development commitment agreement'. <br />Response: Staff supports the requested waiver per the 'Voluntary Development Commitment <br />Agreement'. <br />A brief discussion ensued regarding the front loaded garages. <br />
