Planning & Zoning Commission/ <br />Local Planning Agency <br />November 18, 2015 <br />Page 3 <br />In response to the Commission's question, Ms. Williams said the applicant would need to ensure that during <br />flood events the current flow way would remain in the same state in terms of the amount of volume that is able to <br />dispense during rain events. <br />A brief discussion ensued regarding the size of the drainage easement, the design of the dock and the <br />condition of the soil. <br />Mr. Michael Caiazza, Specialty Marine Contractors, 7151 Rose Avenue, Orlando, Florida came forward. Mr. <br />Caiazza said he is the contractor and engineer for the project. He said he has been building docks in Florida since <br />1977 and it is common to have ditch crossings. Mr. Caiazza said it is common sense that you don't impede flow. He <br />said the dock was positioned in a narrow portion of the creek where it is only a maximum of ten feet. He said it is <br />common sense not to build the pilings in the storm ditch. Mr. Caiazza said that he would be able to obtain an <br />engineer's approval. <br />Mr. Henson asked for a motion to address CU 15 -14. Ms. Campbell made a motion to approve the <br />applicant's request for a dock based on the plans that have been received subject to the applicant providing an <br />engineer's approval and reassurance that the pylons as installed will not interfere with the flow of water within the 100 <br />year floodplain. She said the approval is contingent on the applicant satisfying the five comments as outlined by the <br />City Engineering Department. Mr. Bryan seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: SPR 15.13: The Reserve at Legacy Park. Development of Community Impact Review <br />to create a single family development within the Seminola Overlay District. The property is zoned Planned <br />Mixed -Use: Low Intensity (PMX -L). Property is located on Seminola Boulevard and to the south of Legacy <br />Park Drive. <br />Mr. Bob Cantu, Planner II, reviewed the information provided in staffs memorandum dated November 18, <br />2015, and a PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint Presentation is attached and made a part of the minutes). Mr. Cantu said in August, 2015, the property <br />was rezoned to PD (Planned Development). He said the PD required a Voluntary Development Commitment <br />Agreement which required approval of a conceptual site plan by the City Commission. Mr. Cantu said the plan is in <br />conformance with the Commitment Agreement. Mr. Cantu reviewed the site plan and buffering. <br />
