Planning & Zoning Commission/ <br />Local Planning Agency <br />November 18, 2015 <br />Page 2 <br />Fourth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Fifth Item of Business: CU 15 -14: 168 Norris Place /Boat Dock. Conditional Use for a boat dock in a PRD <br />(Planned Residential Development) residential zoning district. <br />Ms. Emily Hanna, Planner I, reviewed the information provided in her memorandum dated November 18, <br />2015, and a PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint Presentation is attached and made a part of the minutes). Ms. Hanna said that the request meets all the <br />conditional use criteria; however, the City Engineer has provided comments regarding the proper use of mitigative <br />techniques and objects to the permit and the conditional use. Ms. Hanna said Public Work's staff is available to <br />answer any questions. Ms. Hanna said staff recommends denial of CU 15 -14 to allow a residential boat dock at 168 <br />Norris Place. <br />Mr. Henson asked the applicant to come forward. Mr. Ken Herron, 168 Norris Place, Casselberry, Florida <br />came forward. Mr. Herron said it is a standard boat dock that will bridge over the drainage ditch so not to impede any <br />water flow through the ditch. He said that he would hire an outside engineer to evaluate it, if needed, to satisfy the <br />Commissioners that the dock will not create a problem. <br />In response to the Commission's question, Mr. Herron reviewed the five conditions of approval outlined in <br />the staff report and he didn't see any problem meeting the conditions. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />In response to the Commission's question, Ms. Marissa Williams, Natural Resources Officer, said the item <br />of most concern is the crossing of the drainage easement. She said based on the plans that were submitted for <br />review, there appears to be pilings within the ditch. Ms. Williams said the City would need a letter from an engineer <br />stating that the proposed dock would not obstruct the flow through the ditch. She said there are five lakes upstream <br />that drain through that ditch along with a variety of different wetlands and carry it through the Triplet Chain. She said <br />it is an area that can experience high flows during flood periods and the City wants to ensure that it doesn't cause <br />any upstream concerns. <br />
