No disclosure of Ex Parte <br />Communications was made by the Commissioners. <br />Mr. Henson asked the applicant to come forward. Mr. Robin Lopez, 319 Seminola Boulevard, Casselberry, Florida <br />came forward. In response to the Commission's question, Mr. Lopez said he was in agreement with the City Engineer's <br />conditions of approval but questioned the lighting requirement for docks. A brief discussion ensued regarding the regulations for <br />lighting the dock. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />No one came forward. <br />Mr. Henson asked for a motion to address CU 15 -06. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve CU 15 -06, to allow a 50' long private residential dock at 319 Seminola Boulevard. He said the approval is <br />based upon the staff report dated June 10, 2015, the site drawing (Exhibit A), the survey (Exhibit B), the City Engineer <br />conditions of approval (Exhibit C), the Planning and Zoning Commission's findings of fact, and the five (5) conditions outlined in <br />the staff report. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: BA 15 -02: 480 Kentia Road. Variance request to grant a variance to Article VII, Section 2- <br />7.10 "Fences and Walls" of the Casselberry Unified Land Development Regulations to allow a 6.0 foot fence to <br />encroach 5.0 feet into a front yard (corner, side yard) as determined by the principal structure on the lot. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated June 10, 2015, and a <br />PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint presentation is <br />attached and made a part of the minutes). Ms. Regan said the variance application does not meet all six (6) criteria for granting <br />the variance; therefore, staff does not support the variance request as presented. Ms. Regan said if the Planning and Zoning <br />Commission chooses to grant the variance, the Commission will need to demonstrate how the criteria was met and the five (5) <br />conditions outlined in the staff report would apply to the variance. The following is a list of the conditions of approval: <br />1. The fence shall encroach no more than five (5) feet into the front -side yard as determined by the principal structure <br />on the lot. <br />2. The fence shall be located no more than six (6) inches forward of the rear corner of the house along the side <br />corner along Violet Dell Drive. <br />3. The fence shall not exceed six (6) feet in height and shall not be enlarged in any way. <br />4. The fence shall be maintained in good repair and the finished side shall face out. <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />
