Planning & Zoning Commission/ <br />Local Planning Agency <br />June 10, 2015 <br />Page 5 <br />A brief discussion ensued regarding clarification to criteria number 6 and the circumstances for granting previous fence <br />variances in the past. <br />Mr. Henson asked if the Commission had any Ex Parte Communications for this item. No disclosure of Ex Parte <br />Communications was made by the Commissioners. <br />A brief discussion ensued regarding a previous fence variance that was granted for a home on the corner of Winter <br />Park Drive and Park Drive. <br />Mr. Henson asked the applicant to come forward. Mr. Ismael Aviles, 480 Kentia Road, Casselberry, Florida came <br />forward. In response to the Commission's question, Mr. Aviles said he was cited by the Code Compliance Officer for the <br />parking of his boat. Mr. Aviles reviewed fence location options to access his backyard but none of the options would work <br />without obtaining a variance. He said he has parked his boat between the two houses for four years. A brief discussion ensued <br />regarding the parking and screening of recreational vehicles. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />No one came forward. <br />A lengthy discussion ensued regarding meeting the six criteria necessary to grant a variance and a possible placement <br />for the fence to run from the corner of the house running parallel with the sidewalk and not parallel with the house. Ms. Regan <br />stated that the City Code states that the fence needs to run parallel with the house. <br />Mr. Henson asked for a motion to address BA 15 -02. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve BA 15 -02, for the property located at 480 Kentia Road based upon the Planning and Zoning Commission's <br />findings of fact and conclusions, the staff report dated June 10, 2015, the property survey attached as Exhibit A to the staff <br />report, and five (5) conditions outlined in the staff report.
