He said the ordinance was not reviewed by the City Commission because it <br />was thought that the dispensaries would be tied to the areas that are cultivating this type of product which would require larger <br />parcels that are not available in the city. Mr. Woodruff said based on discussions with the City Attorney this is not the case. <br />He said based on the dispensaries opening without the cultivation areas and that the Department of Health has not identified <br />the location for the five (5) dispensaries within the state the City would like to move forward with the moratorium. <br />After a brief discussion, Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in <br />opposition to, the request. No one came forward. <br />A discussion ensued regarding the use of the "white paper" document and that it may contain outdated information. <br />Mr. Henson asked for a motion to address MISC 15 -04, Mr. Van Meter made a motion that the Planning and Zoning <br />Commission provide a favorable recommendation for MISC 15 -04 and the attached ordinance to the City Commission for <br />adoption of a 180 day moratorium on the issuance of business tax licenses, permits, development orders or any other official <br />action related to Low -THC. Mr. Bryan seconded the motion. The motion passed with a majority vote with Mr. Wise casting <br />the dissenting vote. <br />Eighth Item of Business: SPR 15.05: Legacy Park Planned Development Master Land Use Plan Amendment. Request <br />for an amendment to the Legacy Park Planned Development Master Land Use Plan for the purpose of changing the <br />current approved land uses therein. <br />Mr. Henson asked if the Commissioners had any Ex Parte Communications to disclose for SPR 15 -05. No <br />disclosure of Ex Parte Communications was made by the Commissioners. <br />Mr. Randy Woodruff, Development Services Manager, reviewed the information provided in his memorandum dated <br />May 13, 2015, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the <br />PowerPoint is attached and made a part of the minutes). Mr. Woodruff said the applicants' request is to amend the Legacy <br />Park PD Master Land Use Plan for the purpose of changing the current approved land uses within the Master Land Use Plan <br />by replacing the commercial, neighborhood business, village centers and apartments with the relocated Geneva School and <br />re- designating Tract M -1 from `Recreation Park' to `Residential — Garden Homes'. <br />Mr. Henson asked the applicant to come forward. Mr. Jay Klima, 385 Douglas Avenue, Suite 2100, Altamonte <br />Springs, Florida came forward. Mr. Klima said he is available to answer any questions. <br />
