Planning & Zoning Commission/ <br />Local Planning Agency <br />October 8, 2014 <br />Page 9 <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated October 8, 2014, and a <br />PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy is attached and made a part of <br />the minutes). Mr. Sorensen said staff recommends approval with conditions for CU 14 -12 for a conditional use for a nursing <br />home based on the information provided in the staff report dated October 8, 2014, the site plan dated October 2, 2014 as may <br />be amended by the City Commission. <br />Mr. Hale asked the applicant to come forward. Mr. Kevin Bessolo, 556 Central Avenue, St. Petersburg, Florida came <br />forward. Mr. Bessolo said that he had nothing further to add but noted that it is not a nursing home but an assisted living <br />facility. In response to Ms. McKinney question, Mr. Bessolo said that he intends to adopt his testimony from the prior public <br />hearing to be considered as part of this public hearing. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />Ms. Connie Wightman, 1245 Howell Point, Winter Park, Florida, came forward to speak in opposition to this project. Ms. <br />Wightman said she would like to adopt her testimony from the prior public hearing to be considered as part of this public <br />hearing. She said that staff stated there is no mitigation required for assisted living. She said the permitted uses in the PRD <br />are residential and a conditional use is required for nursing homes and assumed assisted living facilities would fall under the <br />nursing home category. Ms. Wightman said the whole concept is that it is a conditional use and if there are no mitigative <br />requirements that would imply that all possible configurations of assisted living facilities are compatible with all neighborhoods. <br />She felt that wasn't true in this case. She said there are certain assisted living facilities that could be built on this site that <br />would be compatible. Ms. Wightman said this particular development does not meet the conditional obligation for the <br />applicant to show that they have used proper mitigative techniques. She said this development is considered as one building <br />and not separate structures. She explained if they were considered separate buildings in the PRD, there would be other <br />requirements for internal circulation and parking. She said the applicant has treated each wing of the building for setback and <br />buffering purposes as if they are separate buildings. <br />Mr. Randy Lightbody, 205 Ranch Road, Winter Park, Florida, came forward to speak in opposition to this project. Mr. <br />Lightbody said he would like to adopt his testimony from the prior public hearing to be considered as part of this public <br />hearing. He said that the design criteria for buildings in excess of 35 feet in height requires setbacks of an additional 15 feet <br />for each additional 10 feet in height or fraction thereof where property abuts residentially zoned areas.
