He said it is the applicant's burden to demonstrate that the proposal satisfied all of the Casselberry's <br />Comprehensive Plan and Land Use Development Requirements; therefore, the conditional use must be denied. He said it is <br />also incumbent on the applicant to demonstrate how the proposed features of the PRD including uses, densities and <br />intensities are compatible with the surrounding uses. He said that it is quite evident to their legal counsel that this <br />development falls out on all accounts; therefore, he asked the Planning & Zoning Commission to deny the application. Mr. <br />Lightbody said it is incumbent upon the Planning and Zoning Commission to protect our neighborhoods, lakes and the <br />environment in Casselberry and to uphold and comply with the City Code and Comprehensive Plan which this project does not <br />do. <br />Mr. David Chulak, 207 Ranch Road, Winter Park, Florida, came forward to speak in opposition to this project. Mr. <br />Chulak said that Section 4 -20 of the ULDR states that the development is supposed to provide safe and convenient internal <br />vehicle circulation. He said the utility area cannot be accessed without going out to Lake Ann Lane which will increase traffic <br />on that road. <br />Mr. Sorensen said a comment was made referencing City Code regarding internal traffic circulation and that portion <br />of the Code is used for subdivision requirements and it does not apply to this project. He said the northern parking lot is for <br />staff and the other parking is for everyone else. He said the parking lots serve two different functions and there would not be <br />traffic between the two parking lots. <br />Mr. Sorensen said the mitigative technique criteria in a conditional use are meant for things such as uses that would <br />cause odors or noise. He said with a nursing home there are no mitigative techniques that would be required. <br />After a brief discussion, Mr. Hale asked for a motion to address CU 14 -12. Mr. Henson made a motion that the <br />Planning and Zoning Commission approve CU 14 -12, conditional use for an assisted living facility, based on the information <br />provided in the staff report dated October 8, 2014, the attached site plan dated October 2, 2014 as may be amended by the <br />City Commission with the attachments of Exhibits A, B, C, D, E and F those being the PRD standards, site plan dated October <br />2, 2014, building elevations, photometric plan, landscape plan dated October 2, 2014 and the conservation easement. Mr. <br />Wise seconded the motion. <br />
