Planning & Zoning Commission/ Local Planning Agency September 10, 2014 Page 4 Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated September 10, 2014, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said that staff recommends approval of CU 14 -14 for a drive -thru located at 1401 State Road 436. Mr. Henson asked the applicant to come forward. The applicant had nothing to add to this item. Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Henson asked for a motion to address CU 14 -14. Mr. Bryan made a motion that the Planning and Zoning Commission approve CU 14 -14, conditional use for a drive -thru located at 1401 State Road 436, based on the information provided in the staff report dated September 10, 2014 and the site plan dated July 18, 2014. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. Eighth Item of Business: CU 14.15: 1555 State Road 436, Suite 1171 -1181 - Los Dos Amigos. Conditional use request for a 4COP (beer /wine /liquor) license. Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated September 10, 2014, and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said staff recommends approval with the following conditions: 1. The conditional use shall be limited to the location of 1555 State Road 436, Suite 1171 -1181. 2. All sales and consumption of alcoholic beverages shall be on -site and indoors. 3. The sale of alcohol shall not exceed 49% of total revenue. 4. The conditional use approval is for alcohol sales in conjunction with a restaurant which primarily serves food. 5. Expansion of the tenant space shall require additional conditional use review. 6. Package sales of alcoholic beverages for off -site consumption are prohibited. 7. The hours of on -site alcohol consumption and sales shall comply with the hours set forth in Section 10.2 of the City of Casselberry's Code and shall only be during times when the primary use (the restaurant) is serving food. 8. The business shall remain in complete compliance with all City, County and State requirements. 9. There shall be no outside display or storage of goods, materials, services or vehicles. 10. The conditional use shall commence within 120 days of the approval. 11. The conditional use shall expire if the use is discontinued for more than 90 days. 12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. Mr. Henson asked the applicant to come forward. The applicant was not present at the meeting. A brief discussion ensued regarding the operating hours of the restaurant and the hours allowed for the sale of alcohol. Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward.
