Planning & Zoning Commission/ <br />Local Planning Agency <br />September 10, 2014 <br />Page 4 <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated September 10, 2014, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said that staff <br />recommends approval of CU 14 -14 for a drive -thru located at 1401 State Road 436. <br />Mr. Henson asked the applicant to come forward. The applicant had nothing to add to this item. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Henson asked for a motion to address CU 14 -14. Mr. Bryan made a motion that the Planning and Zoning <br />Commission approve CU 14 -14, conditional use for a drive -thru located at 1401 State Road 436, based on the information <br />provided in the staff report dated September 10, 2014 and the site plan dated July 18, 2014. Mr. Van Meter seconded the <br />motion. The motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 14.15: 1555 State Road 436, Suite 1171 -1181 - Los Dos Amigos. Conditional use request <br />for a 4COP (beer /wine /liquor) license. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated September 10, 2014, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said staff <br />recommends approval with the following conditions: <br />1. The conditional use shall be limited to the location of 1555 State Road 436, Suite 1171 -1181. <br />2. All sales and consumption of alcoholic beverages shall be on -site and indoors. <br />3. The sale of alcohol shall not exceed 49% of total revenue. <br />4. The conditional use approval is for alcohol sales in conjunction with a restaurant which primarily serves food. <br />5. Expansion of the tenant space shall require additional conditional use review. <br />6. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />7. The hours of on -site alcohol consumption and sales shall comply with the hours set forth in Section 10.2 of the <br />City of Casselberry's Code and shall only be during times when the primary use (the restaurant) is serving food. <br />8. The business shall remain in complete compliance with all City, County and State requirements. <br />9. There shall be no outside display or storage of goods, materials, services or vehicles. <br />10. The conditional use shall commence within 120 days of the approval. <br />11. The conditional use shall expire if the use is discontinued for more than 90 days. <br />12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />Mr. Henson asked the applicant to come forward. The applicant was not present at the meeting. A brief discussion <br />ensued regarding the operating hours of the restaurant and the hours allowed for the sale of alcohol. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />
