Planning & Zoning Commission/ <br />Local Planning Agency <br />September 10, 2014 <br />Page 3 <br />Sixth Item of Business: SPR 14 -10: Pollo Tropical. Major site plan review for a 3,700 square foot drive -thru restaurant <br />with an outdoor dining area of 515 square feet and associated site work. Property located within the Casselberry <br />Commons shopping plaza at 1401 State Road 436. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated September 10, 2014, <br />and a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said staff <br />recommends approval of SPR 14 -10 with the following conditions: <br />1. All Public Works issues must be addressed prior to issuance of a site construction permit. <br />2. The billboard shall be removed. Also, the power pole and all power lines connecting to the billboard shall be <br />removed including the power line over State Road 436 unless the power provider requires it for Pollo Tropical's <br />needs. <br />3. All landscaping must remain in good condition and be kept free of weeds and overgrowth. <br />4. All structures including the sign and dumpster walls shall be harmonious with the existing building character. <br />5. Any required Tree Bank payment must be made prior to issuance of a Certificate of Occupancy. <br />6. All conditions must be fully executed or the site plan becomes null and void. <br />7. The site plan is valid for one year. Failure to obtain a building permit within one year will result in the expiration of <br />the site plan approval. <br />Mr. Sorensen explained that an additional condition was added to the conditions of approval after the staff report was <br />sent out to the Commission. <br />Mr. Henson asked the applicant to come forward. Mr. Chris Blurton, Interplan, 604 Courtland Street, Orlando, Florida <br />came forward. Mr. Blurton said he was available to answer any questions. In response to the Commission's question, Mr. <br />Blurton said that the building will have a stucco appearance. <br />In response to the Commission's question, Mr. Blurton said that he agrees with staffs conditions of approval. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Henson asked for a motion to address SPR 14 -10. Mr. Van Meter made a motion that the Planning and Zoning <br />Commission approve SPR 14 -10 site plan for Pollo Tropical, 1401 State Road 436 based upon the information provided in the <br />staff report dated September 10, 2014 including staffs recommendations with the inclusion of the additional condition of <br />approval. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: CU 14 -14: Polio Tropical Drive -Thru. Conditional use review of a drive -thru in conjunction <br />with a restaurant in the CG zoning district. Property located within the Casselberry Commons shopping plaza at <br />1401 State Road 436. <br />
