No one came forward. <br />A brief discussion ensued regarding granting the 8 foot variance and adding a condition of approval that the fence will <br />match the existing fence. <br />Mr. Meadows asked for a motion to address BA 14 -03. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve BA 14 -03, for the property located at 425 Capron Ash Loop, based upon the Planning and Zoning <br />Commission's findings of fact and conclusions, the staff report dated July 9, 2014, the property survey (Exhibit B), the <br />conditions included in the staff report with an additional condition of approval that the applicant will erect the new fence using <br />the same materials and construction as what is currently in place and that the Planning and Zoning Commission finds that <br />criteria 5 is compatible by adding the 8 foot extension for the fence. Mr. Van Meter seconded the motion. The motion passed <br />unanimously by voice vote. <br />Ninth Item of Business: LPA 14.02 — Landscape and Tree Protection: Amending Article XIII Landscape and Article <br />XIV Tree Protection to revise replacement requirements and update standards and related references. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated June 11, 2014, to the City <br />of Casselberry Planning and Zoning Commission. Ms. Regan presented a PowerPoint presentation (a copy is attached and <br />made a part of the minutes). Ms. Regan requested the Planning and Zoning Commission provide a favorable <br />recommendation to the City Commission for LPA 14 -02 to adopt the draft ordinances for Article XIII Landscaping and Article <br />XIV Tree Protection as part of the Casselberry Code of Ordinances, as provided in the draft ordinances attached to the staff <br />report. <br />A brief discussion ensued regarding residents serving on the Tree Advisory Committee and the Code reference to <br />the St. John's River Water Management District watering restrictions regulations. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry <br />recommended that the voting majority for the Tree Advisory Committee should reside in Casselberry. <br />Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh questioned if the rules and <br />regulations were fair, reasonable and just. He said Casselberry wants to be a tree city. Mr. Fraleigh felt that this was a ploy to <br />
