Planning & Zoning Commission/ <br />Local Planning Agency <br />July 9, 2014 <br />Page 3 <br />Mr. Jason Sorensen, Planner I, said that this item has been withdrawn from the agenda. He said the City Attorney <br />and the City's Administrative Official determined that a variance is not needed at this time. He said that the applicant can <br />move forward with the subdivision waiver request. <br />Eighth Item of Business: BA 14 -03 — 425 Capron Ash Loop - Juekett: Variance application to allow a fence 6 feet in <br />height to encroach 8 feet into a front yard in the PMX -L zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated July 9, 2014, to the City <br />of Casselberry Planning and Zoning Commission. He said the variance application does not meet all six criteria for granting <br />the variance. He said staff does not support the variance request; however, a variance of 5 feet would satisfy criterion #5. <br />Mr. Sorensen said if the Planning and Zoning Commission chooses to grant a variance for a 6 foot fence the motion <br />should be based upon the following conditions: <br />1. The fence shall encroach no more than 8 feet into the front -side as determined by the principal structure on the <br />lot. <br />2. The fence shall be located no more than 7 feet forward of the rear corner of the house along the side. <br />3. The fence shall not exceed six feet in height and shall not be enlarged in any way. <br />4. The fence shall be maintained in good repair and the finished side shall face out. <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and void. <br />Mr. Sorensen said per Section 1- 2.7.D. The Board shall make factual findings on the following items: <br />1. Whether or not requirements of the Unified Land Development Regulations (ULDR) have been met by the <br />applicant. <br />2. Whether or not the reasons set forth in the application justify granting of the variance, and whether the variance is <br />the minimum that will make possible the reasonable use of land, building, or structure. <br />3. Whether or not the granting of the variance will be in harmony with the general purpose and intent of the ULDR <br />and whether or not the variance will be injurious to the neighborhood or otherwise detrimental to the public <br />welfare. <br />A brief discussion ensued regarding granting a 5 foot variance. Mr. Meadows asked the applicant to come forward. <br />Mr. Timothy Juekett, 425 Capron Ash Loop, Casselberry, Florida came forward. Mr. Juekett said he requested the 8 foot <br />variance so that the fence would align with the existing fence. He said they thought it would be aesthetically pleasing to be <br />one straight fence. <br />In response to the Commission's question, Mr. Juekett said that the proposed fence material would match the <br />existing fencing material. <br />
