Planning & Zoning Commission/ <br />Local Planning Agency <br />July 9, 2014 <br />Page 2 <br />Sixth Item of Business: CU 14 -11— 203 Savannah Park Loop - Hunter: Conditional use request for a residential dock. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated July 9, 2014, to the City <br />of Casselberry Planning and Zoning Commission. Mr. Sorensen said Staff finds that the proposed use is compatible with the <br />surrounding land uses. He said Staff recommends approval of the construction of the proposed dock with the following <br />conditions. <br />1. The conditional use shall be limited to the proposed dock structure. The dock shall not be enlarged or enhanced <br />in any way without additional conditional use approval by the Planning and Zoning Commission. <br />2. The construction and maintenance of the dock shall be in accordance with the requirements of all applicable <br />state agencies, the City Engineer's conditions of approval, and the City's ULDR. <br />3. The applicant shall incorporate dock lighting into the plans prior to submitting for a building permit. This lighting <br />shall illuminate the entire length of the dock as required by Section 94 -6. <br />4. A building permit for the dock shall be obtained within 90 days of the approval and a final inspection shall be <br />obtained within 180 days of the issuance of the building permit. <br />5. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />Mr. Meadows asked the applicant to come forward. Mr. Steve Goonen, Premier Deck & Dock, P.O. Box 2043, <br />Windermere, Florida came forward. Mr. Goonen questioned the use of the dock lighting for a lake that is not a navigable lake <br />and would not pose a hazard. Mr. Sorensen said that the elimination of the dock lighting would require approval by the City <br />Engineer and requested the Commission's approval allow the applicant and the City Engineer to work out the lighting <br />requirements. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Meadows asked for a motion to address CU 14 -11. Mr. Hale made a motion to approve CU 14 -11 to allow a <br />private residential dock at 203 Savannah Park Loop based on the staff report dated July 9, 2014, the site drawing (Exhibit A), <br />the survey (Exhibit B), the Planning and Zoning Commission's findings of fact, and the conditions of approval in the staff report <br />with a modification to Condition Number 3 to state that the applicant shall incorporate dock lighting as prescribed by the City <br />Engineer prior to submitting for a building permit. Mr. Bryan seconded the motion. The motion passed unanimously by voice <br />vote. <br />Seventh Item of Business: BA 14 -02 — 487 State Road 436 - Sun State Capital Properties, L.L.C.: Variance application <br />to reduce the required 20 foot rear yard setback in the CG zoning district by 8 feet to allow for a covered porch to be <br />12 feet from a proposed southwest property line. <br />
