Planning & Zoning Commission/ <br />Local Planning Agency <br />April 9, 2014 <br />Page 4 <br />said that they are in agreement with staff's recommended site plan modification. Mr. Jackson said that dumpster <br />enclosure will be constructed using block and it will match the building fagade, A brief discussion ensued regarding <br />the location of the handicapped parking stalls, the noise generated from the patio area and the type of buffering that <br />will be used to buffer the noise generated from that area. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry questioned the parking lot layout. <br />Mr. Meadows asked for a motion to address SPR 14 -03, Mr. Bryan made a motion that the Planning and <br />Zoning Commission approve SPR 14 -03, site plan for Chipotle restaurant at 103 State Road 436, based on the <br />information provided in the staff report dated April 9, 2014, the staff preferred site plan provided in tonight's <br />presentation and the landscape plan dated March 10, 2014 with the changes needed to accommodate staffs <br />preferred site plan, the building elevations provided in the staff report, and the four conditions outlined in the staff <br />report. Mr. Wadley seconded the motion, The motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 14 -06 — Chipotle 2COP BeerMine: Request for a 2COP license in conjunction <br />With a restaurant at 103 State Road 436. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated April 9, 2014, <br />to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said if the Planning and Zoning <br />Commission's approves CU 14 -06 to allow the on -site consumption of beer and wine as allowed by the 2COP state <br />license, in conjunction with the operation of a restaurant located at 103 State Road 436, it should be based on the <br />findings of fact and conclusions of the staff report dated April 9, 2014, and the following conditions: <br />1, The conditional use shall be limited to the location of 103 State Road 436. <br />2. All sales and consumption of alcoholic beverages shall be on -site. Sales shall be confined to indoors <br />and the outside patio area as shown on staffs preferred site plan as presented tonight. <br />3. The sale of alcohol shall not exceed 49% of total revenue. <br />4. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />5. The hours of alcohol sales shall comply with the hours set forth in Section 10.2 of the City of <br />Casselberry's Code as long as the use is in conjunction with a restaurant. <br />6. The business shall remain in complete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within one year of building permit issuance for construction. <br />9. The conditional use shall expire if the use is discontinued for more than ninety days. <br />
