Finding of Fact: The Special Magistrate made a finding in case # 15 -00378 , 871 Seminola Blvd. There was a previous <br />hearing requiring a correction by 5/28/2015, the correction has been made and there is no fine. A standing order will stand <br />saying this should not happen again. <br />Fence maintenance, ULDR Section 3 -10.3 (B) <br />• CE -15 -00388 327 Elm Dr <br />John Cecil, Lead Code Compliance Officer advised that staff recommended an order that the violation be corrected by <br />May 28, 2015, or a fine of $25 per day be assessed for each day after May 28, 2015, until the Fence violation is corrected. <br />The subject violation was found not to be corrected on May 28, 2015 and still in violation of Section 3 -10.3 (B). <br />The Special Magistrate asked if the owner for 327 Elm Dr was in the audience. There was no one present. <br />Finding of Fact: The Special Magistrate made a finding that this case came for hearing on 5/14/2015, that the property <br />was in violation of the ULDR. It was ordered that the property come into compliance 5/28/2015 or face a fine of $25.00 <br />per day each day after 5/28/2015. There was no one present. <br />Finding of Fact: The Special Magistrate made a finding that there was a hearing on 5/14/2015; the property was found in <br />violation of ULDR 3 -10.3 (B). It was ordered that the violation be corrected by 5/28/2015 or face a fine of $25.00 per day. <br />As of 5/28/2015 this violation has not been corrected, the $25.00 fine was imposed to begin 5/28/2015. <br />NEW CASES <br />No Building Permit, City Code Section 1 -4.3 <br />• CE -15 -00536 1565 Carlisle Dr <br />Nathan Johnson, Code Compliance Officer advised that the subject violation was found to not be corrected and the <br />property remains in violation of Section 1 -4.3 Building Permits. Therefore, staff requests an order that the violation be <br />corrected by June 25, 2015, or a fine of $25 per day be assessed for each day after June 25, 2015, until the Property has <br />been found in compliance. <br />The Special Magistrate asked if the owner for 1565 Carlisle Dr was in the audience. The owner was present. <br />Robert Tryon 1565 Carlisle Dr gave testimony, submitted the signed Building Permits for the property and asked to <br />approach. Mr. Tryon stated he had a permit to fill the fish pond. According to Mr. Tryon he only needs a final for a chain <br />link fence. <br />Mr. Tryon stated the inspector at the time said anything on the outside of the shed is purely decorative. Mr. Tryon thought <br />the only thing he needs is a final on a 4 ft fence. Mr. Tryon continued. <br />Mr. Johnson advised that the permits for the fence and pond were never completed and voided, they were not finaled, <br />copies were put in the case files. Mr. Johns has spoken to Mr. Tryon on the phone prior to the meeting. It was asked that if <br />Mr. Trying had any proof that the permits had been signed off, that the City did not have, it was asked that he bring it in. <br />The Special Magistrate asked if Mr. Johnson had looked at the permit on the podium, on a clip board. <br />31 Page <br />
