FINDING OF FACT: The Special Magistrate read each case into record and found that the properties have come into compliance and no fines should be imposed. The City recommends a total lien reduction to $1,000, due to the property owner already paying $4,159.04, for administrative cost and demolition of the structure. The current owner was not the violator and the $250 per cases would cover City cost to date. The Special Magistrate asked if the property owner was present for these cases. Larry Powalisz, Helion Investments stated that if the Magistrate was going to do the recommended reduction, he was fine with that. FINDING OF FACT: The Special Magistrate made a finding that based on the evidence of record; there were previous orders of code violations CE- 09- 01849, CE -11- 00857, CE -11 -02459 and CE -11- 02460, equaling $60,861. Based on the mitigating circumstances and evidence on record the fine will be reduced to $1,000 ($250 per case), so ordered. The property owner has already paid $628.37, this covered administrative cost and the owner is not the violator.
