(H) The provision of Street Lighting Services specially benefits all Developed <br />Property by protecting and enhancing its value, use and enjoyment. <br />(1) The provision of Street Lighting Services and the operation and maintenance <br />of street lights provides beautification, better property identification and recognition, and <br />enhances safety and accessibility of Developed Property, as well as preserving and /or <br />enhancing the value and marketability of property within the Street Lighting Service Area <br />through the provision of uniform street lighting services. <br />(J) The apportionment of Street Lighting Assessments based on the size of Tax <br />Parcels and Equivalent Residential Units is a fair and reasonable method for allocating the <br />special benefit conveyed by Street Lighting Services among Developed Property. <br />(K) The provision of Street Lighting Services for Vacant Property primarily <br />benefits adjacent Developed Property rather than preserving the value of Vacant Property <br />or the use and enjoyment of the Vacant Property. Accordingly, Vacant Property shall be <br />exempt from the Street Lighting Assessment contemplated hereunder. As Vacant Property <br />is developed, an Assessment shall be imposed against the previously Vacant Property <br />based upon the apportionment methodology adopted herein and such property shall be <br />added to the Street Lighting Assessment Roll approved by a subsequent Annual <br />Assessment Resolution in accordance with Section 3.08 of the Assessment Ordinance. <br />(L) It is fair and reasonable to use ERUs assigned based upon the size of Tax <br />Parcels to apportion the Street Lighting Assessed Cost because the necessary pole <br />spacing and illumination required to meet the City's lighting standards is driven by the size <br />of the Tax Parcel. <br />N. <br />
