Street Lighting Service Area. Therefore, it is fair and reasonable to adopt a rate structure for <br />the Street Lighting Assessments which is applied uniformly throughout the Street Lighting <br />Service Area. <br />(E) While homeowners' associations associated with Excluded Subdivisions fund <br />street lights which illuminate platted roadways, a multi - family parcel funds lighting within that <br />parcel, much as a large commercial parcel funds interior lighting to illuminate parking and <br />building access. The function of the street lights funded by the respective homeowners' <br />associations for Excluded Subdivisions is the same as the function of the street lights <br />funded by the City's assessment program, that is, the lighting of platted right -of -ways. <br />Therefore, if Excluded Subdivisions were not exempted from the Street Lighting <br />Assessments, Tax Parcels in those subdivisions would be funding street lighting on platted <br />right -of -ways twice, once through the Assessment and again through the membership fees <br />and dues paid by association members. <br />(F) However, in multi - family parcels comprising apartment complexes, the lights <br />that are funded internally for illumination within the parcel are not duplicative of the lights on <br />platted external right -of -ways funded by the Street Lighting Assessments. Therefore, it is <br />appropriate to include multi - family parcels in the Street Lighting Assessment program and to <br />treat such parcels as General Parcels for purposes of apportionment. <br />(G) The Street Lighting Services contemplated herein are essential municipal <br />services which possess a logical relationship to the use and enjoyment of, and provide a <br />special benefit to, Developed Property and the costs associated with such services may be <br />recovered, in whole or in part, through the imposition and collection of Street Lighting <br />Assessments. <br />INA <br />
