FINDING OF FACT: Mr. Guzman made a finding that the respondent failed to correct the violation by the time <br />specified of 1/23/2014, a fine of $25.00 per day is imposed as set forth in the Order and will run until the property is <br />brought into compliance and a date of compliance has been filed by the Code Inspector. The respondent is further <br />ordered to notify the Code Compliance officer to verify compliance with this order. <br />REDUCTION REQUEST <br />Abandoned/neglected real property, Art VI Chapter 58 Sec 6(a) <br />• CE -11 -03009 710 Benedict Way <br />Mr. Guzman read this case into record. <br />Mr. Hull advised the Magistrate of the following, the above violation was by U S Bank for not registering the <br />property as a foreclosure. All notices were sent to the foreclosure attorney, Certified mail was signed for. The <br />property was in violation for 932 days and the property was registered by Bank of America on 6/3/2013. The City <br />does not recommend a reduction of the lien, due to all mailings being received and no action taken. <br />Tom Murphy, broker /owner of Thomas Murphy and Associates. Nationstar asked Mr. Murphy to handle this <br />request. Mr. Murphy stated they just wanted a reduction if at all possible. <br />FINDING OF FACT: Mr. Guzman made a finding to deny this request for reduction, based on insufficient <br />evidence. <br />Parkin utility trailer(s), ULDR Section 3 -10.9 <br />• CE -13 -00570 Vacant, N Winter Park Dr <br />Mr. Guzman read this case into record. <br />Mr. Hull advised the Magistrate of the following, the above violation was by Thomas G. Freeman, for parking a <br />utility trailer on a vacant lot. All notices were sent to the post office box provided as a mailing address in the <br />Seminole County Property Appraiser website, per Florida statues. The property was also posted on 8/29/2013, by <br />Officer Hull. The owner stated the Post office closed his Post office box and he was not notified. Since the Post <br />office box was closed the owner did not receive any notification from the City. The property was in violation for 95 <br />days, lien amount $2,375. The property was found in compliance on 12/30/2013. The City recommends a reduction <br />of 75% of this lien to a total of $593.75. <br />Mr. Saso attorney for Mr. Freeman advised they were asking for a reduction/total waiver of the lien, in this cases <br />there was a lack of due process. Mr. Saso proceeded to question Mr. Freeman. There was also a court reporter <br />resent. <br />Mr. Saso read a section of Florida Statute 162.12 (2)(a) in reference to posting the property. <br />FINDING OF FACT: Mr. Guzman made a finding that the property was in violation, there was indication of <br />constructive notice and the property was compliant with due process. The property was posted and the property was <br />posted at City Hall. Mr. Guzman than quoted Florida Statute 162.12 (2)(a).
