Planning & Zoning Commission/ <br />Local Planning Agency <br />March 12, 2014 <br />Page 5 <br />The motion passed with a majority vote. <br />Mr. Meadows asked for a motion to address ZB 14 -01. Mr. Wadley moved that the Planning and Zoning Commission <br />recommend approval of the PRD rezoning request (ZB 14 -01) for the subject property as provided in the ordinance attached <br />as Exhibit A to the staff report for the property located east of the Seminola Boulevard and Button Road intersection as <br />provided in Table 1 of the staff report, based on the staff report dated March 12, 2014 including the four findings and the <br />discussion at tonight's meeting. As part of the motion that the PRD Standards for Assisted Living Memory Care strike the fifth <br />and sixth floors from the site table so that the building height is limited to four stories. Also that staff add the following items: <br />1. Any fence, wall, or supporting wall shall be constructed of brick. Chain link fencing is not allowed. <br />2. Add to the site requirements that 1 space per bed is required for independent living. <br />3. Conditional use request to operate a non - traditional use in the <br />CG zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated March 12, 2014, to the City <br />of Casselberry Planning and Zoning Commission. Mr. Sorensen said staff recommends approval of CU 14 -04 with the following <br />conditions: <br />1. Before a Business Tax Receipt is issued for this business, staff shall inspect the location for adherence to Section <br />2 -7.30, <br />2. The intensity shall be limited to four body art stations. A new conditional use will be required to expand the number <br />of stations. <br />3. The business shall remain in compliance with the criteria in Section 2 -7.30, Non - Traditional Uses. <br />4. If the use ceases for more than 90 days, the conditional use shall become null and void. <br />5. All conditions must be fully and faithfully fulfilled or the conditional use shall become null and void. <br />After a brief discussion regarding hazardous waste associated with a tattoo establishment, Mr. Meadows asked the <br />applicant to come forward.
