Planning & Zoning Commission/ <br />Local Planning Agency <br />March 12, 2014 <br />Page 6 <br />explained the process for collecting and disposing of the hazardous waste generated by his business. He said he is licensed by <br />the state for the hazardous waste generated by his business. A general discussion ensued regarding the requirements in the City <br />Code dealing with hazardous waste. Ms. Robin McKinney, attorney, read the portion of the City Code dealing with hazardous <br />waste. It was decided that the Planning and Zoning Commission would add an additional condition of approval stating that the <br />business must comply with all state and federal law for hazardous waste. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh felt that the public did not participate in the <br />rezoning agenda item making it null and void. Mr. Meadows explained that at the beginning of the future land use change and <br />rezoning presentation he stated that both questions and public discussion were going to be combined in both those motions. <br />Mr. Fraleigh felt that diversity of businesses was good for the community. He felt that the hazardous waste for the <br />business should have been addressed before the meeting. Mr. Fraleigh felt that information is not being presented properly to the <br />Planning and Zoning Commission. <br />After a brief discussion, Mr. Meadows asked for a motion to address CU 14 -04. Mr. Bryan moved that the Planning and <br />Zoning Commission approve CU 14 -04 to allow a Non - traditional use (body art establishment) at 910 State Road 436, based on <br />the findings of fact and conclusions of the staff report dated March 12, 2014, and the five conditions outlined in the staff report and <br />that the hazardous waste produced by this operation will comply with state and federal regulations. Mr. Wadley seconded the <br />motion. The motion passed unanimously by voice vote. <br />Ninth Item of Business: CU 14 -05: 1006 State Road 436 /ltalia Restaurants. Conditional use request to serve beer and <br />wine within a restaurant in a CG zoning district. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated March 12, 2014, to the City of <br />Casselberry Planning and Zoning Commission. Ms. Regan said upon review of the conditional use request, staff recommends the <br />Planning and Zoning Commission approve CU 14 -05 to allow the on -site consumption of alcoholic beverages as allowed by the <br />2COP state license, in conjunction with the operation of a restaurant located at 1006 State Road 436 and the following conditions: <br />1. The conditional use shall be limited to the location of 1006 State Road 436. <br />2. All sales and consumption of alcoholic beverages shall be on -site and indoors. <br />3. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />4. Alcohol sales shall be ancillary to food sales. Sale of alcoholic beverages shall not exceed 49% of total revenue. <br />5. The hours of alcohol sales must be within business hours and shall comply with the hours set forth in Section 10 -2 of <br />the City of Casselberry Code. <br />
