Planning & Zoning Commission/ <br />Local Planning Agency <br />January 8, 2014 <br />Page 6 <br />Mr. Aruims Singh, applicant, 1176 Paseo Del Mar, Casselberry, Florida came forward. Mr. Singh gave the <br />ownership history of the property. He said that they wanted to make improvements to the site and to add a diesel <br />pump to the site. He said that he hired an architect/engineer to do a site modification for the diesel pump and they <br />thought it was approved and the diesel pump was added to the site. He said based on his discussions with the <br />landscaping companies he requested a meeting with staff to discuss the landscaping on the site. He said staff would <br />not meet with him because there was an additional pump placed on the site that was not approved by the City. <br />Mr. Aruims said that they met with staff regarding the diesel pump and he said that he would eliminate the <br />additional diesel pump and he would apply for an extension to the conditional use to allow him time to do an alternate <br />landscape plan. He said after the meeting he received an email from the City stating that the pump was illegal and it <br />needed to be removed and he would need to apply for a new conditional use. Mr. Aruims said that the additional <br />diesel pump has been removed. He said the site will meet all the landscaping requirements; however, he would like <br />to open up before the completion of the landscaping work. <br />Mr. Aruims said the existing lighting will be used on the site and no new lighting will be added to the site. He <br />said you cannot change the bulbs without replacing the entire fixture. He said this was a condition that was added <br />from the original conditional use approval and requested that condition be removed from the approval. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said no one <br />mentioned that one of the owners was murdered in the store due to lack of the Casselberry Police Department being <br />around. <br />Mr. Fraleigh said that this person is trying to make a living. He said it is the American Dream to own a <br />business. He said the City is harassing people that are trying to bring business and tax dollars to our community. <br />Mr. Fraleigh felt that the City should allow him 6 months to come into compliance with the landscaping. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry felt <br />that it was good to have a diesel pump on the site. He said he didn't know of any particular restriction that would not <br />allow that diesel pump on the site. <br />In response to the Commission's question, Mr. Sorensen said the additional diesel pump was added without <br />a permit. Ms. Smith explained that it was the Fire Marshal's determination that the pump needed to be removed due <br />
