A general discussion ensued regarding the landscaping requirements for the site, <br />code enforcement action if the site does not comply with the landscaping requirements and waving the condition of <br />approval regarding the landscaping inspection needing to be completed before fuel dispensing can commence. <br />Mr. Aruims said there were six additional conditions of approval added to this request that were not included <br />in the original conditional use approval. He said he will provide the required landscaping but he needs to get the <br />business open. A general discussion ensued regarding the conditions of approval. <br />Mr. Meadows asked for a motion to address CU 14 -03, Mr. Hale made a motion to approve CU 14 -03 to <br />allow a fuel- dispensing service station use at 201 State Road 436, based on the findings of fact and conclusions of <br />the staff report dated January 8, 2014, and the following conditions: <br />1. The landscape plan dated December 24, 2013 (Exhibit E) shall meet all requirements of Article XIII, <br />Landscaping, of the City's Unified Land Development Regulations and be completed within 60 days of <br />this approval. Irrigation shall be provided and maintained on -site in a good working condition to <br />maintain healthy vegetation. <br />a. An additional canopy tree shall be provided in the southwestern portion of the site; location <br />to be approved by staff. <br />b. The existing magnolia tree as shown in Picture 5 of the staff report shall be replaced. <br />c. All dead, dying, or unhealthy shrubs shall be replaced according to the landscape plan and <br />shall meet a minimum height of 24 ". <br />d. Fuel DisperisiRg shall net GemmenGe unto! the landscape plan has passed inspeGtian. <br />e. All landscaping shall be maintained so as to present a neat and orderly appearance and be <br />kept free of weeds and overgrowth. Dead palm fronds shall be removed. <br />2. All applicable Federal, State, County and other agency permits shall be submitted to the City prior to <br />the issuance of a building permit. <br />3. All applicable licenses and permits shall be obtained prior to the commencement of all business <br />activities at the site. <br />4. There shall be no outside sales (except for the fuel pump sales), storage, or display of goods, materials <br />or services. <br />5. The property shall be maintained in accordance with Section 3 -10.3. Minimum Maintenance Standards. <br />Design, 6. Site lightiRg shall not eXGeed the maximurn light levels of AFtiGI8 X. The conditional use for fuel dispensing shall be for the four (4) permitted existing fuel pumps (eight <br />fueling stations) located under the existing canopy as shown on the site plan (Exhibit E). Additional fuel <br />pumps shall require additional conditional use approval. <br />8. A new conditional use application shall be required if fuel dispensing should cease for more than ninety <br />(90) days. <br />9. The conditional use shall be implemented within one hundred twenty (120) days or the conditional use <br />shall become null and void. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />
