Ms. Debbie Stiegel, 421 Cortland Avenue, Winter Park, <br />Florida came forward. Ms. Steigel explained that the property is a 6 unit park and one of the buildings has an <br />Industrial zoning designation. She said they are considering rezoning the entire property. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward to speak in favor of this <br />request. Mr. Fraleigh said the City needs to be flexible with the needs and wants of the developed areas in the City. <br />He said it doesn't make sense that there are two different zoning designations in the same industrial park. Mr. <br />Fraleigh felt that the church should, be able to hold special events. <br />Mr. Meadows asked for a motion to address CU 14 -01. Mr. Bryan made a motion that the Planning and <br />Zoning Commission's approve CU 14 -01 to allow the use of a church at 420 Live Oaks Boulevard, based on the <br />findings of fact and conclusions of the staff report dated January 8, 2014, and the five conditions listed in the report. <br />Mr. Wadley seconded the motion. The motion passed unanimously by voice vote. <br />Ninth Item Business: CU 14.03: 201 State Road 436 /Mike) Isaac. Conditional use request to allow fuel <br />dispensing in conjunction with a convenience store in the CG zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated January 8, <br />2014, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department), Mr. Sorensen said upon review of the conditional use request, the Planning and Zoning Commission's <br />approval of CU 14 -03 to allow a fuel- dispensing service station use at 201 State Road 436, should be based on the <br />findings of fact and conclusions of the staff report dated January 8, 2014, and the following conditions: <br />The landscape plan dated December 24, 2013 attached as Exhibit E to the staff report shall meet all <br />requirements of Article XIII, Landscaping, of the City's Unified Land Development Regulations and be <br />completed within 60 days of this approval. Irrigation shall be provided and maintained on -site in a good <br />working condition to maintain healthy vegetation. <br />a. An additional canopy tree shall be provided in the southwestern portion of the site; location <br />to be approved by staff. <br />b. The existing magnolia tree as shown in Picture 5 of the staff report shall be replaced. <br />c. All dead, dying, or unhealthy shrubs shall be replaced according to the landscape plan and <br />shall meet a minimum height of 24 ". <br />d. Fuel Dispensing shall not commence until the landscape plan has passed inspection. <br />e. All landscaping shall be maintained so as to present a neat and orderly appearance and be <br />kept free of weeds and overgrowth. Dead palm fronds shall be removed. <br />2. All applicable Federal, State, County and other agency permits shall be submitted to the City prior to <br />the issuance of a building permit. <br />3. All applicable licenses and permits shall be obtained prior to the commencement of all business <br />activities at the site. <br />
