Planning & Zoning Commission/ <br />Local Planning Agency <br />January 8, 2014 <br />Page 3 <br />He said that good sidewalks were removed and there are neighborhoods that are in need of sidewalks. He <br />said get government out of property and make sure they are providing services only. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry said <br />he is not a big fan of CRA's because the long term CRA's do not put money back into the tax base until <br />redevelopment. He said it appears that most of the money spent by the City's CRA was for land acquisition. He said <br />the flyover delayed development in the City. <br />He said as far as he knows the City did not start the flyover project. He said he read the original report and <br />the intersection was supposed to be at a Level Service F in 2014. Mr. Casselberry said that he thought that the City <br />Commission controls development in the City and the CRA is a committee type organization that votes on money. <br />Mr. Casselberry said at this time he is in favor of the CRA term extension. <br />Mr. Meadows asked for a motion to address CRA 14 -01. Mr. Hale made a motion that the Planning and <br />Zoning Commission acting as the City's Local Planning Agency recommend approval of the Community <br />Redevelopment Agency Plan Update and find that it is in compliance with the Comprehensive Plan as presented to <br />the Commission in the staff report. Mr. Bryan seconded the motion. The motion passed unanimously by voice vote. <br />Eighth Item of Business: CU 14 -01: 420 Live Oaks Blvd /LOC Partners, LLC. Conditional use request to allow <br />a church use within the Industrial zoning district. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated January 8, 2014, <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Ms. Regan said staff recommends approval of the conditional use request. She said the Planning and <br />Zoning Commission's approval of CU 14 -01 to allow the use of a church at 420 Live Oaks Boulevard should be <br />based on the findings of fact and conclusions of the staff report dated January 8, 2014, and the following conditions: <br />1. All church activity shall be conducted inside the building. <br />2. Any expansion of the area above 3100 square feet or increase in intensity of the use as a church shall <br />require an additional conditional use review and approval. <br />3. Special Events shall not be permitted within the Industrial zoning district as defined in Section 14 -42 of <br />the City's Unified Land Development Code. <br />4. The use shall remain in complete compliance with all City, County and State requirements. <br />5. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question regarding property taxes for the site, Ms. Smith explained that the <br />property is owned by a private owner and it does not have any type of tax deferral because of the church use. <br />
