Planning & Zoning Commission/ <br />Local Planning Agency <br />October 9, 2013 <br />Page 8 <br />Mr. Meadows asked for a motion to address LPA 13 -09. Mr. Wadley made a motion that the Planning and Zoning <br />Commission sitting as the Local Planning Agency provide a favorable recommendation to the City Commission for LPA 13- <br />09 as amended and presented by staff at tonight's meeting including the amendment recommended by members of the <br />Planning and Zoning Commission for LPA on page 2 Section 86 -3(a) that end of that sentence should read "prior to <br />issuance of certificate of occupancy" rather than "until such time as the certificate of occupancy is issued ". Ms. Regan stated that this information is for commercial properties only. <br />A general discussion ensued regarding option 4 that was provided in the PowerPoint presentation and the <br />Commission scheduling a workshop to allow for more public participation. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh felt the Commission was <br />heading in the right direction but felt that both commercial and residential properties needed to meet the same requirements. <br />He felt that the Tree Bank Fund was being used for as a source of extortion. He said the Cash for Gold site doesn't have <br />any type of landscaping but then other businesses are required to have 20 trees. Mr. Fraleigh felt that requiring trees on <br />commercial sites block the view of the businesses and causes a safety issue. <br />Mr. Fraleigh said he was in favor of the Planning and Zoning Commission conducting a public workshop. <br />
