Planning & Zoning Commission/ <br />Local Planning Agency <br />June 12, 2013 <br />Page 12 <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said we have <br />a developer that is bringing a business and tax revenue to our community. He said we don't want to speed the <br />review of the project but it seems everything has been covered. Mr. Fraleigh felt that it was beneficial to the City to <br />keep this project moving forward. He said time is money and we should not delay this project. Mr. Fraleigh felt that it <br />was a good and reasonable offer brought before the Commission. He felt that any changes would require Planning <br />and Zoning Commission review. <br />A discussion ensued regarding additional approval required for the future retail development on the site. <br />Mr. Meadows asked for a motion to address SPR 13 -03. Mr. Bryan made a motion that the Planning and <br />Zoning Commission approve SPR 13 -03 for the Bojangles drive -thru restaurant at 200 State Road 436, based on the <br />information provided in the staff report dated June 12, 2013, the site plan dated May 14, 2013, the building <br />elevations, and the 5 conditions outlined in the staff report. Mr. Wadely seconded the motion. The motion passed <br />unanimously by voice vote. <br />After a brief discussion, Mr. Wadley amended the motion for SPR 13 -06 to remove the tree waiver request <br />from the landscape sheet. Mr. Bryan seconded the motion. The motion passed unanimously by voice vote. <br />CU 13.02 <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated June 12, 2013, <br />to the City of Casselberry Planning and Zoning Commission (a copy is file in the Community Development <br />Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />Mr. Sorensen said staff recommends approval. He said if the Planning and Zoning Commission approve <br />CU 13 -02, conditional use for a drive -thru in a CG zoning district, it should be based on the information provided in <br />the staff report dated June 12, 2013, and the site plan dated May 14, 2013. <br />Mr. Meadows asked the applicant to come forward. Ms. Rebecca Wilson, Lowndes, Drosdick, Doster, <br />Kantor & Reed, 215 North Eola Drive, Orlando, Florida came forward. A brief discussion ensued regarding a by -pass <br />lane for the drive -thru. <br />
