Planning & Zoning Commission( <br />Local Planning Agency <br />June 12, 2013 <br />Page 11 <br />In response to the Commission's question regarding the appearance of the future retail development site <br />after the Bojangles building is finished, Ms. Wilson stated that the site would meet the City's requirements for a <br />phased project. She said that the hardscape, landscaping, and sod would be completed and maintained for the <br />future retail site. <br />Mr. David Axel, Axel Real Estate, 1757 West Broadway Street, Suite 1, Oviedo, Florida came forward. Mr. <br />Axel said their understanding based on discussions with staff that the site could not exceed certain thresholds on the <br />property without coming back to the Planning and Zoning Commission. He said their intention was to develop a plan <br />that would come before the Planning and Zoning Commission once. He said that building is the maximum envelope <br />that would be built on the site. Mr. Axel said construction would not begin until a tenant has been secured for the <br />site. Mr. Axel said the intention is to market the site without coming back for additional approval by the Planning and <br />Zoning Commission. <br />Mr. Sorensen stated that staff approves the proposed site plan for the building pad for the future retail <br />development. A discussion ensued regarding review of projects located within the Community Redevelopment <br />District (CRD) by the Community Redevelopment Agency (CRA). Ms. Smith explained that generally all elevations <br />are taken to the CRA for approval; however, the current Board has indicated that they are relying on staff to review <br />the plans. Ms. Smith explained that the CRA review process is subject to change. She said staff could bring the <br />elevations to the Planning and Zoning Commission for review for the proposed future retail development site if they <br />requested staff to do so. <br />Ms. Wilson said the Code requires that the CRA review the elevations for development within the <br />Community Redevelopment District (CRD). She said the CRA has decided that they don't want to review the plans. <br />She felt that it was unfair to add additional review time to the development of the site by adding another review by the <br />Planning and Zoning Commission. Ms. Wilson felt that they have shown good faith in how they handled the <br />elevations at the Planning and Zoning Commission level. She said they would not construct a building that would <br />deteriorate from the integrity of the Bojangles site. Ms. Wilson felt they should submit their elevations to the CRA as <br />required by other development within the CRD. <br />
