Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh felt this <br />development was good for the community. <br />Mr. Meadows asked for a motion to address CU 13 -02. Mr. Wadley made a motion that the Planning and <br />Zoning Commission approve CU 13 -02, conditional use for a drive -thru in a CG zoning district, based on the <br />information provided in the staff report dated June 12, 2013, and the site plan dated May 14, 2013. Mr. Bryan <br />seconded the motion. The motion passed unanimously by voice vote. <br />Twelfth Item of Business: SPR 13.05: Casselberry Trail, Section III. Major site plan review for construction <br />of Section III of the Casselberry Wirz Trail system. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated June 12, 2013, <br />to the City of Casselberry Planning and Zoning Commission (a copy is file in the Community Development <br />Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />Mr. Sorensen said should the Planning and Zoning Commission choose to approve SPR 13 -05 for the <br />proposed Wirz Park Trail - Section 3, the approval should be based upon the attached site plan dated April 22, 2013, <br />the findings of fact and conclusions of the staff report dated June 12, 2013, and the following conditions: <br />1. All signage for the site shall conform to the City's Unified Land Development Regulations where <br />applicable. All proposed signage shall be submitted as a separate building permit. <br />2. All associated hardscape structures shall conform to the City's Unified Land Development Regulations. <br />Building permits are required for all hardscape structures. <br />3. The applicant shall obtain a tree removal permit prior to the issuance of any building permit associated <br />with this project. The applicant shall coordinate with Community Development staff to ensure that <br />replacement trees are provided for the trees removed for this project. <br />4. Community Development staff shall perform and approve a landscape inspection prior to completion of <br />the Section 3 project. Any materials which do not meet the requirements of the ULDR's shall be <br />replaced prior to inspection approval. <br />5. No site engineering construction activities shall take place at the site until permits are issued by the <br />City's Public Works Department. <br />6. All permits from appropriate State and County agencies shall be obtained prior to the submittal for a site <br />engineering permit to the City's Public Works Department, <br />7. The site plan approval shall be valid for one year upon approval by the Planning and Zoning <br />Commission. An extension request may be submitted prior to the expiration of this approval. <br />8. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and <br />void. <br />
