Mr. Mikiel Isaac, 12101 NW 4th Street, Plantation, <br />Florida came forward. Mr. Isaac agreed to the Commission's request to replace the tree at the southwest corner of <br />the site. A brief discussion ensued regarding replacing the gates on the dumpster enclosure. <br />Mr. Isaac provided color renderings of the site to the Commission (copies are attached and made a part of <br />the minutes). <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry was concerned that this site could be impacted if Oxford Road or State Road 436 were widened in the <br />future. <br />Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said he objected to <br />changing the time of the meeting. He said the redevelopment of Oxford Road is greatly affecting this site. He said <br />the individual has a right to be in business. He said it is advantageous to the City to bring businesses to the <br />community. Mr. Fraleigh said we want to promote a friendly city. <br />Mr. Meadows clarified that the City Commission changed their meeting time but the Planning and Zoning <br />Commission has maintained their meeting time. <br />After a brief discussion, Mr. Meadows asked for a motion to address CU 13 -08. Mr. Bryan made a motion <br />that the Planning and Zoning Commission's approve CU 13 -08 to allow a fuel- dispensing service station use at 203 <br />State Road 436, based on the findings of fact and conclusions of the staff report dated July 10, 2013, and modifying <br />the conditions of approval to read: <br />1. The landscape plan dated June 2, 2013 shall meet all requirements of Article XIII. Landscaping of the <br />City's Unified Land Development Regulations and be completed within 30 60 days of this approval. <br />2. All landscaping shall be maintained so as to present a neat and orderly appearance and be kept free of <br />weeds and overgrowth. <br />3. All applicable Federal, State, County and other agency permits shall be submitted to the City prior to <br />the issuance of a building permit. <br />4. All applicable licenses and permits shall be obtained prior to the commencement of all business <br />activities at the site. <br />5. There shall be no outside sales (except for the fuel pump sales), storage, or display of goods, materials <br />or services. <br />6. The property shall be maintained in accordance with Section 3 -10.3. Minimum Maintenance Standards. <br />7. A new conditional use application shall be required if fuel dispensing should cease for more than ninety <br />(90) days. <br />8. The conditional use shall be implemented within one hundred twenty days (120) days or the conditional <br />use shall become null and void. <br />
