Planning & Zoning Commission/ <br />Local Planning Agency <br />July 10, 2013 <br />Page 3 <br />Mr. Meadows asked for a motion to address LPA 13 -02. Mr. Wadley made a motion that the Planning and <br />Zoning Commission sitting as the Local Planning Agency provide a favorable recommendation to the City <br />Commission for LPA 13 -02 to amend the City of Casselberry Code of Ordinances, Chapter 26. Businesses; Article III. <br />Peddlers, Solicitors, Begging and Panhandling; Division 1. Peddlers and Solicitors of Goods in Residential Areas as <br />amended in the ordinance attached to the staff report. Mr. Bryan seconded the motion. The motion passed <br />unanimously by voice vote. <br />Sixth Item of Business: CU 13.08: 201 State Road 436 /Texaco. Conditional use request for fuel dispensing in <br />a CG zoning district. <br />Mr. Jason Sorensen, Planner, explained that the sign has an address of 201 State Road 436; however, the <br />building has an address of 203 State Road 436. Mr. Sorensen reviewed the information provided in his <br />memorandum dated July 10, 2013, to the City of Casselberry Planning and Zoning Commission (a copy is on file in <br />the Community Development Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached <br />and made a part of the minutes). <br />Mr. Sorensen said staff recommends approval of CU 13 -08 to allow a fuel- dispensing service station use at <br />203 State Road 436, based on the findings of fact and conclusions of the staff report dated July 10, 2013, and the <br />following conditions: <br />1. The landscape plan dated June 2, 2013 shall meet all requirements of Article XIII. Landscaping of the <br />City's Unified Land Development Regulations and be completed within 38 60 days of this approval. <br />2. All landscaping shall be maintained so as to present a neat and orderly appearance and be kept free of <br />weeds and overgrowth. <br />3. All applicable Federal, State, County and other agency permits shall be submitted to the City prior to <br />the issuance of a building permit. <br />4. All applicable licenses and permits shall be obtained prior to the commencement of all business <br />activities at the site. <br />5. There shall be no outside sales (except for the fuel pump sales), storage, or display of goods, materials <br />or services. <br />6. The property shall be maintained in accordance with Section 3 -10.3. Minimum Maintenance Standards. <br />7. A new conditional use application shall be required if fuel dispensing should cease for more than ninety <br />(90) days. <br />8. The conditional use shall be implemented within one hundred twenty days (120) days or the conditional <br />use shall become null and void. <br />9. Live Oaks shall be high rise live oak trees. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A discussion ensued regarding the quality of the tree located on the southwest corner of the site and the <br />Commission recommended that the tree be replaced. <br />
