CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />NOVEMBER 14, 2013 <br />0 CE -13 -00805 227 Brighton Way <br />Officer Hull advised the Code Board that the above cases were not in compliance by the date set by the <br />Board and fines should be imposed. <br />Jason Ruggerio, Attorney representing Wells Fargo Bank for 529 Grandview Way E, advised this property <br />was in the process of foreclosure. <br />MOTION: Mr. Herron move to find that Respondents in these cases failed to correct the violations by the <br />time specified in this Board's prior orders in these cases and the fine will be imposed as set forth in those <br />orders and will continue to run until the properties are brought into compliance and an affidavit of <br />compliance has been filed by the Code Inspector. Respondents shall notify the Code Compliance Officer <br />to verify compliance. Ms. Aparicio seconded the motion. The motion passes unanimously. <br />REDUCTION REQUESTS <br />Property maintenance \stagnant water, ULDR Section 3 -10.3 7 <br />• CE -10 -02067 815 Osceola Trl <br />Overgrown property, ULDR Section 3 -10.3 <br />• CE -10 -02068 815 Osceola Trl <br />Officer Hull advised that the above violations were from the previous owner and there is an active <br />sales contract on this property. If reduced, the reduction would go directly to the City Manager for <br />final approval. The City recommends a reduction of 75 % to $10,062.50, based on the fact that the <br />current owner was not the violator. This home was in foreclosure when the violation occurred; the <br />owner at the time had abandoned the property. <br />Larry Powalisz, managing member of Helion Investments. Mr. Powalisz was unaware of this code <br />violation, this was first noticed when they get the contract for purchase. Had he seen even close to <br />$10,000, he would not have purchased the property. <br />Discussion. <br />MOTION: Mr. Herron moved that the Board recommend to the City Manager that the lien will be <br />reduced in this case from $ 40,250.00 to $5,050.00, to be paid within 60 days of the City Manager's order <br />or the fine reverts to the original fine amount. The reason for this reduction is mitigating circumstance <br />and Mr. Aparicio wants to see a nice house rather than one that is run down. Ms. Aparicio seconded the <br />motion. The motion passed, with Ms. Hale voting nay. <br />Land clearing/filling, ULDR Section 3 -10.6 <br />• CE -11 -00423 123 Triplet Lake Dr <br />Officer Hull advised the Board that the property owner requests a reduction/waiver of the lien on the <br />above property. This property was in violation for 144 days at $100.00 per day, total lien amount is <br />$14,400.00. The violation was for, Land clearing, excavation or fill without site plan approval.
