CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />NOVEMBER 14, 2013 <br />City does not recommend a reduction based on the history of violations as there have been 35 <br />assorted violations since 2005. <br />Suzie Tran, 123 Triplet Lake Drive, property owner advised that the reason for the violation was she <br />did not know the fill was a violation. She thought the fill would make a nice beach area at the lake. <br />The fill was obtained from the workers at the construction site across the street. Ms. Tran stated the <br />reason for the high charge was that she did not have money to correct the violation and has also been <br />ill. <br />MOTION: Mr. Lutz moved that the Board recommend to the City Commission that the lien reduced <br />from $14,400 to $2,000 to be paid within 60 days of the date of the commission's order or the lien <br />reverts back to the original amount. The reason for the reduction is financial hardship. There was not <br />a second. <br />Discussion. <br />MOTION: Mr. Herron moved that there be no fine reduction in this case. Mr. Smith seconded the <br />motion. The motion passed, with Ms. Hale and Mr. Lutz voting nay. <br />Business tax receipt, City Code Section 26.33 <br />• CE -13 -00574 304 Live Oaks Blvd <br />Officer Hull advised the Board that the property owner requests a reduction/waiver of the lien on the <br />above property. This violation was for a former tenant not paying their Business tax receipt, due to <br />an illness with the business owner. The City recommends a reduction of 75% to $175.00 based on <br />this extenuating circumstance. <br />Debbie Stiegel, 421 Cortland Ave, Winter Park gave testimony. Ms. Stiegel represents the property <br />owners, as a property manager. The property owner received a notice that the tenant did not bay for <br />the business tax receipt and this was sent to her, who sent it on to the tenant. Ms. Stiegel was not <br />aware that the business had actually shut down. May of the businesses there [ in the office complex] <br />are not retail, so they may not be open every day, weeks can go by without seeing a tenant. <br />MOTION: Mr. Smith moved that the Board recommend to the City Commission that the lien will be <br />reduced in this case from $ 700.00 to $175.00, to be paid within 60 days of the commission's order or the <br />fine reverts to the original fine amount. The reason for this reduction is mitigating circumstance and a <br />recommendation from the City of Casselberry. Mr. Herron seconded the motion.
