CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />APRIL 11, 2013 <br />MOTION: Mr. Smith moved to find Respondent in this case was in violation of City Code as charged and <br />failed to correct the violation by the time specified for correction by the Code Compliance Officer; that the <br />violation is now corrected and no fine imposed. Any violation of the same code by Respondent within <br />FIVE (5) years from the date of this Order shall be treated as a repeat violation, for which a fine of up to <br />$500.00 per day may be imposed. Mr. Herron seconded the motion. The motion passed unanimously. <br />NEW CASES <br />General regulations impacting parking areas, ULDR Section 3 -15.4 D, F <br />• CE -12 -01596 4650 S Highway 17/92 <br />Mr. Hull, Code Compliance Officer, gave testimony for the above case. This case was opened by <br />former Code Compliance Supervisor Ketron Brown, for the above property, after an anonymous <br />complaint. The violation is for parking in an unapproved site. Site plan has been submitted. <br />John Herbert, engineer, American Civil Engineering, advised they had re- submitted a week prior to <br />this meeting date. Mr. Herbert stated the contractor stated he could have this built in 60 days. Mr. <br />Herbert asked to a compliance date of 60 days from the date of approval or the plans. Mr. Herbert <br />stated he would expect a permit in about 3 weeks. <br />Mr. Smith stated another solution would be not to park cars there, and he never sees the parking lot <br />full. <br />Mr. Herbert stated people may be parking there because of the shade factor. The area is supposed to <br />be for employee parking. <br />Discussion. <br />MOTION: Mr. Herron moved to find Respondents in this case in violation of the City Code as charged <br />and that Respondents correct the violation before 1:00 p.m. on 04/25/2013. In the event Respondent does <br />not comply by this date, a fine in the amount of $25.00 per day will be imposed for each day the violation <br />continues past the aforestated date. The Respondents are further ordered to contact the Code Compliance <br />Officer to verify compliance with this Order. Mr. Smith seconded the motion. The motion passed <br />unanimously. <br />Fence maintenance, ULDR Section 3 -10.3 (B) <br />• CE -13 -00021 236 Plaza Oval Dr <br />Mr. Hull, Code Compliance Officer, gave testimony for the above case. There was no one present to <br />speak for this case. <br />MOTION: Mr. Herron moved to find Respondent in this case in violation of the City Code as charged <br />and that Respondent correct the violation before 1:00 p.m. on 04/25/2013. In the event Respondent does <br />not comply by this date, a fine in the amount of $25.00 per day will be imposed for each day the violation <br />continues past the aforestated date.
