CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />MARCH 14, 2013 <br />Jabez Martinez, 27106 Arrowbrook Way; Wesley Chapel, FL, representing his father Yran Martinez. <br />Yran Martinez is currently out of the country and was also out of the country at the time of the <br />violation. A person was left in charge of maintaining the grass and such, and the person did not <br />advise him (of the violation) even though he had the contact information. Mr. Martinez found out <br />about the violation the day he came home and the next day he took care of it. The power company <br />also trimmed limbs and then the tree was dead when he returned. Mr. Martinez is also on a fixed <br />income and does not have the money to pay for this. <br />MOTION: Mr. Bakalla moved that the Board recommend to the City Commission that the lien will <br />be reduced in this case from $3,325 to $1,663, to be paid within 60 days of the commission's order <br />or the fine reverts to the original fine amount. The reason for this reduction is financial hardship. Mr. <br />Smith seconded the motion. Ms. <br />Smith asked if there was anyone present to speak for this case. There was no one present. <br />MOTION: Mr. Smith moved that the Board recommend to the City Commission that the lien <br />reduction request be denied based on the request being made by the title company and not the <br />current owner. Mr. Lutz seconded the motion. Ms. <br />Smith asked if there anyone present to speak for this case. A representative was present for this case. <br />Valerie Crane, owner /broke of Profitable Properties, 578 Lake Howell Rd; Maitland, FL 32751. Ms. <br />Crane is the listing agent and representative for Federal Home Loan Mortgage Corporation, aka <br />Freddie Mack. Ms. Crane stated this fine was imposed upon the previous property owner; the home <br />was foreclosed in October 2012 by Chase. The property owner at the time was offered cash for keys <br />to help her move and finally moved out on November 22, 2012. The bank had no authority to enter <br />the property until it was vacated and they had possession. <br />MOTION: Mr. Smith moved that the Board recommend to the City Commission that the lien will <br />be reduced in this case from $3,650 to $1,225, to be paid within 60 days of the commission's order <br />or the fine reverts to the original fine amount. The reason for this reduction is title issues. Mr. Herron <br />seconded the motion.
