CITY OF ' <br />CODE ENFORCEMENT BOARD <br />MARCH 14,2013 <br />Ms. Smith, Interim Community Development Director, advised the Code Enforcement Board that the <br />above case was in compliance by the date set by the Board and no fine should be imposed. <br />MOTION: Mr. Herron moved to find that Respondent(s) in this case have complied with the Board's <br />prior order by the date specified in that Order and no fine will be imposed. Mr. Bakalla seconded the <br />motion. The motion passed unanimously. <br />REDUCTION REQUESTS <br />Fence maintenance, ULDR Section 3 -10.3 (B) <br />® CE -11 -01288 1292 Avalon Blvd <br />Ms. Smith, Interim Community Development Director, gave testimony for the above case. Ms. <br />Smith asked if there was anyone present to speak for this case. A representative was present for this <br />case. <br />Aaron Hines, attorney representing GMAC Mortgage, 2727 W. Cypress Creek Rd: Fort Lauderdale, <br />FL gave testimony for the above case. GMAC received certificate of title for this property on July <br />09, 2012, and was not able to correct the violation until they has title on the property. The violation <br />was cured on November 02, 2012. The bank request the lien be from when they took title of the <br />property to when the repair was made for a total of 116 days. <br />MOTION: Mr. Smith moved that the Board recommend to the City Commission that the lien will <br />be reduced in this case from $48,300 to $11,600, to be paid within 60 days of the commission's <br />order or the fine reverts to the original fine amount. The reason for this reduction is, as soon as the <br />violation could be corrected it was. Mr. Herron seconded the motion. The motion passed <br />unanimously. <br />Landscape maintenance, ULDR Section 3 -13.9 (B) <br />® CE -12 -00728 432 Ranch Trl ^^ <br />Ms. Smith, Interim Community Development Director, gave testimony for the above case. Ms. <br />Smith asked if there was anyone present to speak for this case. There was no one present. <br />MOTION: Mr. Smith moved that the Board recommend to the City Commission that the lien <br />reduction request be denied based on the request being made by the bank and not the current owner. <br />Mr. Bakalla seconded the motion.
