CASSELBERRY CITY COMNIISSION <br />Minutes of July 8, 2013 —Regular Meeting <br />Page 11 of 15 <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 13 -1393. The following <br />individuals came forward: <br />Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to Ordinance 13 -1393, stating he <br />felt the proposed changes were unnecessary. <br />MOTION: Commissioner Hufford moved to approve Ordinance 13 -1393 on first reading, <br />as presented. Motion was seconded by Vice Mayor Solomon. <br />Discussion: A brief discussion ensued regarding the proposed increases and reductions in impact fees. In <br />response to questions from Commissioner Hufford, Ms. Smith clarified that the impact fees were not property <br />taxes, but were fees assessed on new development or expansion of existing development within the City to <br />cover the cost of additional services. She added that for expansions, credit would be given for fees collected <br />previously and additional fees would be based only on the additional square footage. <br />Motion carried unanimously by voice vote 5 -0. <br />B. Second Reading- of Ordinance 13 -1392 — Repealing Chapter 86 Utilities, Section 86- <br />68(f) Recovery of Capacity <br />The City Clerk read Ordinance 13 -13 92 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, REPEALING SECTION 86- <br />68(F), RECOVERY OF CAPACITY, CHAPTER 86, UTILITIES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 13 -1392 was published in the <br />Orlando Sentinel on June 27, 2013. <br />Staff Presentation: Mr. Newlon explained that this ordinance eliminates a two -year cap that the current Code <br />language placed on sewer benefit fees. He stated that the removal of this cap would allow the City to grant <br />credits related to sewer fees, which would in turn make the City more competitive with other utilities and <br />would be more equitable to those desiring to develop within the City. <br />Budget Impact: There is no impact to the City budget. <br />Recommendation: The City Manager and the Interim Community Development Director recommended <br />approval of Ordinance 13 -1392. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 13 -1392. No one came <br />forward to address Ordinance 13 -1392. <br />MOTION: Vice Mayor Solomon moved to adopt Ordinance 13 -1392 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5 -0. <br />
