CASSELBERRY CITY COMMISSION <br />Minutes of April 22, 2013 — Regular Meeting <br />Page 9 of 14 <br />MOTION: Commissioner Aramendia moved to continue the public hearing for first <br />reading of Ordinance 13 -1392 to the May 13, 2013 City Commission meeting, as <br />requested. Motion was seconded by Vice Mayor Solomon. Motion carried <br />unanimously by voice vote 5 -0. <br />A. Ordinance 13 -1388 — Amending the Definition of "Salary" for the City of <br />Casselber7y's Police Officers' and Firefighters' Pension Plan <br />The City Clerk read Ordinance 13 -1388 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 62, <br />PENSIONS AND RETIREMENT, ARTICLE 1, POLICE OFFICERS' AND FIREFIGHTERS' <br />PENSION PLAN, OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY; <br />AMENDING SECTION 62 -2001, DEFINITIONS; PROVIDING FOR CODIFICATION; PROVIDING <br />FOR SEVERABILITY OF PROVISIONS; REPEALING ALL ORDINANCES IN CONFLICT <br />HEREWITH AND PROVIDING AN EFFECTIVE DATE." <br />Staff Presentation: Mr. Newlon explained that in 2011 the Legislature had passed Senate Bill 1128 which <br />established a limit on what could be considered salary for the purposes of defining pension benefits for <br />members of police officers' and firefighters' local pensions such as the City of Casselberiy's plan. He stated <br />that the effective date for what was provided in the law was set in the future at the time that each locality <br />established a new collective bargaining agreement with the members of those pension plans. He noted that this <br />occurred for the City of Casselberiy at the beginning of this fiscal year. He added that from that date forward, <br />salary was redefined to include no more than 300 hours of overtime, and also upon retirement it would no <br />longer allow the inclusion of accrued sick leave and vacation benefits that might be paid out at that time. <br />Mr. Newlon explained that the import of this was that it would save the City on continuing pension <br />contributions going forward, but it was necessary to change the City's ordinance to conform to the new state <br />law. He added that the ordinance being presented for consideration was prepared by the City's pension <br />attorney and referred to the Commission from the Pension Board. He noted that it would serve to put the <br />requirements of the new law into the City's Code. <br />Public Hearing: The following individuals came forward to address Ordinance 13 -1388: <br />Mr. John Casselberry, 700 South Lost Lake Lane, expressed concerns about the <br />unpredictability of including overtime into calculations of the pensions. He inquired whether <br />the pensions would actually be increased by incurring overtime. Mayor Glancy advised that <br />staff could answer his questions outside of the meeting. Mr. Newlon advised he would be <br />happy to answer Mr. Casselberry's questions after the meeting. <br />2. Mr. James Fraleigh, 23 Teresa Court, also expressed concerns about the possibility of <br />overtime affecting the pension calculations. He voiced additional concerns about the public <br />not getting answers to their questions at the City's public meetings, stating he felt citizens <br />
