CASSELBERRY CITY COMMISSION <br />Minutes of June 10, 2013 — Regular Meeting <br />Page 14 of 16 <br />k <br />Advised that she had received word that Judge Rudisill would be entering an order granting the City's <br />Motion to Dismiss in the Pleasants case. She added that it was being dismissed without prejudice, and <br />that the Judge was reserving ruling on the City's entitlement to attorneys' fees at this time. She <br />advised she would keep the Commission posted. <br />Reported an Order dismissing the Complaint with prejudice had been entered in a federal case in <br />which the City and two police officers had been sued. She added that this case was being referred to <br />the presiding United States Magistrate Judge for report and recommendations as to the propriety of <br />Rule 11 sanctions for filing of a frivolous case. <br />Advised of a recent Florida Supreme Court decision in Palm Bay vs. Wells Fargo which was basically <br />a defeat for Home Rule. She explained that various cities, including the City of Casselberry, have <br />provisions that say that their code liens have super priority status equivalent to tax liens. She farther <br />explained that this Supreme Court decision was an appeal to the Palm Bay case, and the Court <br />basically ruled that the city's regulations were in conflict with the statutes. She added that the <br />language in the ruling was not favorable to Home Rule and did not bode well for the pending red light <br />camera case. <br />• Gave a brief update on some recent legislative changes relating to elections. She advised there were a <br />myriad of changes, but called attention to two in particular which would have a significant impact on <br />the City. These were the change to the primary election date, resulting in the City's next election date <br />changing to August 26, 2014, and an increase in the number of financial reports that candidates are <br />required to file. She added that the number of required reports had more than doubled. <br />Commissioner Anthony Aramendia — Seat No. 1: <br />• Reported that the Get Outdoors Casselberry and the Hot Rods and Rock N Roll events were both very <br />successful and had great turnouts. <br />• Congratulated Dr. Kelly Brock and all City staff members who made the Clean Air Award possible. <br />Added that it was nice to be laiown as the first city in Seminole County to receive the award. <br />• Advised that Friends of the Park would be assisting with a project at Secret Lake Park on June 17, <br />2013 coordinated by Hands On Orlando. He stated that Altria Group, Inc. (formerly Philip Morris <br />Companies, Inc.) would be providing their own volunteers, and would be funding the project by <br />providing approximately $10,000 worth of enhancements to the park, including mature bald cypress <br />trees and boulders. <br />• Commended Chief Harkins and the Fire Department for their proactive work on the fire at Serve -Pro <br />and the two recent gas leaks. He also thanked the Police Department for their assistance with these <br />incidents. <br />
