CASSELBERRY CITY COMMISSION <br />Minutes of June 10, 2013 — Regular Meeting <br />Page 12 of 16 <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 13 -1391 was published in the <br />Orlando Sentinel on May 30, 2013. <br />Staff Presentation: Interim Community Development Director Sandra explained that this item pertained to <br />the zoning change that went hand in hand with the future land use changed just adopted. She noted that the <br />zoning amendment involved twenty -two (22) parcels of property, whereas the land use change only involved <br />ten (10). She stated the reason for this was because many of the properties for which the zoning amendment <br />was being requested had already been changed to the MTUM (Major Thoroughfare Mixed Use) land use <br />designation. <br />Ms. Smith advised that there were two zoning classifications associated with the Major Thoroughfare Mixed <br />Use designation, PMX -HIGH and PMX -MID. She stated that what was being requested for this item was the <br />PMX -MID designation which allows up to six stories in height and provides for a mix of commercial and <br />residential uses. She added that the residential uses could accommodate up to twenty -five (25) dwelling units <br />per acre. She noted that this was the second reading for this ordinance and was a public hearing. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Interim Community Development Director recommended <br />approval of ordinance 13 -1390. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 13 -1390. The following <br />individuals came forward: <br />1. Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to Ordinance 13 -1390, expressing <br />concerns about making any changes to the usage of park space. He also voiced concerns <br />about the negative effect he felt the development of high rise buildings and additional office <br />buildings in these locations would have on the family values and image of the City. <br />2. Mr. John Casselberry, 700 South Lost Lake Lane, also spoke in opposition to Ordinance 13- <br />1390, reiterating his earlier concerns about changing the zoning or usage of City park space, <br />and stating he would not recommend any changes at this time. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 13 -1391 <br />Ms. Smith advised that the language regarding the effective date of Ordinance 13 -1391 had also been amended <br />to read as follows: "This Ordinance shall become effective immediately upon its passage and adoption for <br />properties A, B, C, I, K, L, M, N, Q, R T and U, as referenced in Section 1 above. This Ordinance shall <br />become effective for properties D, E, F, G, H, O, P, S, V and W, as referenced in Section 1 above, upon the <br />effective date of Ordinance 13 -1390. If Ordinance 13 -1390 does not become effective, then the zoning shall <br />not change for properties D, E, F, G, H, O, P, S, V and W, as referenced in Section 1 above." She explained <br />that basically this meant that should the future land use designation not be approved by the State, then the <br />zoning changes would not come into effect, but if it was approved by the State, then the zoning changes would <br />come into effect. <br />MOTION: Vice Mayor Solomon moved to adopt Ordinance 13 -1391, on second and final <br />reading, as amended. Motion was seconded by Commissioner Aramendia. <br />
