WHEREAS, words with double underlined type shall constitute additions to the original text and s#ke <br />through shall constitute deletions to the original text. <br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the City of Casselberry, Florida: <br />SECTION 1. That Section 14 -28, Permit required, of Chapter XIV, Amusements, of Part II, Code of <br />Ordinances, of the City of Casselberry, Florida shall be amended as follows: <br />Sec. 14.28. Permit required. <br />(a) No person shall advertise, engage in, participate in, aid, form or start any special event or <br />seasonal or open air sale or erect any tent or temporary structure for public access for such an event <br />unless a special event/sales permit is first obtained from the City of Casselberry. <br />(b) This Section shall not apply to: <br />(1) Funeral processions; <br />(2) Lawful picketing; and <br />(3) Any bona fide athletic event or contest or other special event sponsored by any public or <br />private school; and <br />4) The City's designated special use parks. <br />SECTION 2. That Section 14 -30, Other permits, inspections, of Chapter XIV, Amusements, of Part II, <br />Code of Ordinances, of the City of Casselberry, Florida shall be amended as follows: <br />Sec. 14-30. — Other permits; inspections. <br />(a) In addition to the special event, open air sales, open air food sales or seasonal sales permit fee, an <br />occupational license shall be required pursuant to Section 26 -33 of the City Code. In the case of a special <br />event, the ecGupational lise business tax receipt shall not be issued until a special event permit has been <br />obtained and the cost of the ecatiena{ license business tax receipt shall be based on the number of <br />exhibitors (both retail and service vendors) that will be participating in the special event. <br />(b) A building permit shall be required, as applicable, for erection of any temporary structure, such as a tent, <br />stage, or other structure used to conduct the special event or sale. <br />(c) A fireworks permit shall be obtained from the Fire Department after the special event permit is approved and <br />issued. <br />(d) If alcoholic beverages are to be sold during a special event an alcoholic beverage license shall be obtained <br />from the Florida Bureau of Alcohol. Tobacco and Firearms after receiving approval from the Community <br />Development Department. <br />Ue The event or sale shall begin only after all inspections by affected departments have been conducted and a <br />determination has been made that all codes and ordinances have been satisfied. All necessary inspections <br />of tents and /or temporary structures must be conducted and approved prior to opening of the special event, <br />open air or seasonal sale. <br />SECTION 3. That Section 14 -45, Special event alcoholic beverage permits, of Chapter XIV, <br />Amusements, of Part II, Code of Ordinances, of the City of Casselberry, Florida shall be amended as follows: <br />Sec. 14 -45. — Alcoholic beverage permits for special events within city parks.
