(a) Criteria for permit. The following criteria will be the basis upon which a permit for the possession or consumption of <br />alcoholic beverages during a particular event will be granted fora not for profit coFpemfion or governor special event: <br />(1) The applicant must complete an "alcohol use liability agreement" to submit with the permit application and pay <br />an additional $25.00 fee for the use of alcoholic beverages at the event. <br />(2) The applicant must obtain an insurance policy, in an amount not less than $1,000,000.00, specific to the <br />consumption of alcoholic beverages, and the City must be named as additionally insured. The Citv of <br />Casselberry reserves the right to require additional types of insurance coverage or higher limits of liability for <br />an even . <br />(3) Alcoholic beverages must be consumed only in the pre- authorized event area and only during the permitted <br />time. <br />(4) At functions expected to involve more than 50 individuals, the applicant is responsible for providing a minimum <br />of one off duty Casselberry Police Officer or Seminole County Sheriff to insure safety and security. <br />(5) Alcoholic beverages may only be dispensed in plastic or paper cups; no glasses, cans or bottles will be <br />permitted. <br />flNo more than three alnnhek beverage use-permits <br />calendar year, <br />(7-The event will be open to the general public. <br />U7 *If the applicant is a not for profit corporation, the organization's nonprofit certification from the State of Florida <br />must be current and valid. Also, applicant shall provide a copy of proof of their tax exempt status from the IRS. <br />8� (9)- Event permit request must be submitted to the City-Glerk Community Development Department a minimum of <br />30 days prior to the scheduled event, and all other city, county and state permits, if required, need to be <br />enclosed. <br />(9 40) If alcoholic beverages are to be sold the following additional conditions apply: <br />a. The application fee will be an additional $75.00 $100.00, inste-ad of the $25.00 tee; <br />b. A minimum of two uniformed off duty City of Casselberry police officers or Seminole County Sheriffs must <br />be hired to ensure safety and security; <br />c. The sale ef a!Gehe!'G beverages must be in GenjunGtion with a City spensered or City approved <br />GOTmTunity, .Vlo or gharitahle event; and <br />d- Proof of licensing by the State of Florida, Department of Business Regulation, Division of Alcoholic <br />Beverage and Tobacco ( "one -day permit ") is provided. <br />1U0 {a �} No event shall run more than three consecutive days. <br />1U1 ( The permit shall allow sale, possession, and consumption of beer and wine only. <br />1U2 43) The permit shall contain such additional reasonable conditions as are deemed necessary by the City <br />Commission City Manager or his /her designee in accordance with these guidelines. <br />(b) In determining whether such permit should be issued, the City Gernmissi en City Manager or his/her designee may <br />consider, among other factors, the nature of the event; the anticipated number, age and conduct of persons attending the <br />event; the days and time of the event; the uses of areas near the special event; and the anticipated impact the sale, <br />possession or consumption of alcoholic beverages would have on the public place, its uses and the special event. <br />(c) The City Gommissien City Manager or his /her designee shall decide within ten days from the receipt of the permit <br />application by the City Clerk, or at its first meeting after filing of the permit whichever is later, whether or not to grant the <br />permit. In the event of a denial the notification shall include the reason for the denial. Any aggrieved person shall appeal <br />the City Genimissiee City Manager or his /her designee's decision to the courts City Commission. <br />SECTION 4: CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be <br />made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this <br />Ordinance may be renumbered or re- lettered to accomplish such intention; that the word, "Ordinance" may <br />be changed to "Section," "Article," or other appropriate word. <br />SECTION 5: CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br />Ordinance 12 -1373 <br />Page 3 <br />
