Planning & Zoning Commission/ <br />Local Planning Agency <br />December 14, 2011 <br />Page 5 <br />In response to the Commission's question regarding the enforcement of Christmas decorations that are left <br />up all year, Ms. Smith explained that the proposed revisions to the Code do not address aesthetics. She explained <br />that public nuisance deals with health, safety and welfare issues. <br />Mr. Bakalla said that he has not been at the last few meetings and he had some questions regarding the <br />proposed changes to the Code. Mr. Bakalla said he had an issue regarding the trash cans being removed from the <br />curb by 9:00 p.m. on the day of collection. Ms. Smith explained that this is a tool to help with the enforcement for the <br />residents that leave their trash cans at the curb for several days. Ms. Smith explained that the Code Enforcement <br />Officer provides a door hanger notifying the resident of the code violation. She said if the violation continues, the <br />Code Enforcement Officer will send a notice of code violation and if it still continues, the resident goes before the <br />Code Enforcement Board. <br />Mr. Bakalla questioned how the Code Enforcement Officers would track the trash can violations. Ms. Smith <br />stated that the Code Enforcement Officers know their neighborhoods and the people in the neighborhood. She said <br />they know what is out there on a continuous basis. Ms. Smith said that the Code Enforcement Officers are not <br />policing trash cans on a daily basis. She said if there is a problem on a property the Code Enforcement Officers have <br />a tool to address the issue. <br />Mr. Bakalla expressed a concern with the swimming pool standards. Ms. Smith stated that the proposed <br />Code states that pools will be maintained in good working order to prevent stagnant water and the water clarity will <br />be maintained so the bottom of the pool is visible and free from any debris and shall be protected with an <br />enclosure /fence with safety locks. Mr. Bakalla questioned the enforcement of this Code due to the Code <br />Enforcement Officers limited ability to see the bottom of the pool. Ms. Smith explained that this is a tool to help with <br />enforcement. Mr. Bakalla questioned if the deepest end or the shallow end of the pool would be used to determine <br />clarity. Mr. Bakalla also questioned how the clarity would be determined if the pool was covered. <br />Mr. Bakalla expressed a concern with enforcing removal of trash cans from the curb if left at the curb for two <br />days.
