Planning & Zoning Commission/ Local Planning Agency December 14, 2011 Page 4 In response to the Commission's question, Ms. Smith stated that this item is scheduled to go before the City Commission for first reading at the January 9, 2012 meeting. Ms. Smith explained that this item would be considered legislation in progress and the City Commission could make the Board appointments based on the fact that this is going through the process. She said the City Commission could also decide to wait until the ordinance is approved and make the Board appointments in February. Ms. Smith explained that the City Commission could decide to activate the Board of Adjustment at a later date. She said that the Community Development Director wanted all appeals to go before the Planning and Zoning Commission because he felt that Board was better prepared to make determinations of the City Code. A general discussion ensued regarding changing the term limits for the various boards. Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Parkhurst asked for a motion to address LPA 11 -11. Mr. Bakalla made a motion to provide a favorable recommendation to the City Commission for the ordinance attached to the staff report for LPA 11 -11, ULDR Amendments to multiple sections of the City Code consolidating the Planning and Zoning Commission and the Board of Adjustment. Mr. Meadows seconded the motion. The motion passed unanimously by voice vote. Seventh Item of Business: LPA 11.13: Property Maintenance /Public Nuisance Continued. Amending portions of the City Code including Chapter 70, "Solid Waste ", Chapter 58, "Offenses and Miscellaneous Provisions ", and ULDR Article X, "Appearance, Design and Compatibility" to differentiate between public nuisances and property maintenance criteria and the affiliated methods for compliance. Ms. Sandra Smith, Development Services Manager, reviewed the information provided in her memorandum dated December 7, 2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Ms. Smith provided a PowerPoint presentation (a copy is attached and made a part of the minutes). Ms. Smith reviewed the changes that she and the City Attorney made to the verbiage regarding outdoor /open air storage.
