Planning & Zoning Commission/ <br />Local Planning Agency <br />December 14, 2011 <br />Page 4 <br />In response to the Commission's question, Ms. Smith stated that this item is scheduled to go before the City <br />Commission for first reading at the January 9, 2012 meeting. Ms. Smith explained that this item would be considered <br />legislation in progress and the City Commission could make the Board appointments based on the fact that this is <br />going through the process. She said the City Commission could also decide to wait until the ordinance is approved <br />and make the Board appointments in February. Ms. Smith explained that the City Commission could decide to <br />activate the Board of Adjustment at a later date. She said that the Community Development Director wanted all <br />appeals to go before the Planning and Zoning Commission because he felt that Board was better prepared to make <br />determinations of the City Code. <br />A general discussion ensued regarding changing the term limits for the various boards. Mr. Parkhurst asked <br />if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came <br />forward. <br />Mr. Parkhurst asked for a motion to address LPA 11 -11. Mr. Bakalla made a motion to provide a favorable <br />recommendation to the City Commission for the ordinance attached to the staff report for LPA 11 -11, ULDR <br />Amendments to multiple sections of the City Code consolidating the Planning and Zoning Commission and the Board <br />of Adjustment. Mr. Meadows seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: LPA 11.13: Property Maintenance /Public Nuisance Continued. Amending <br />portions of the City Code including Chapter 70, "Solid Waste ", Chapter 58, "Offenses and Miscellaneous <br />Provisions ", and ULDR Article X, "Appearance, Design and Compatibility" to differentiate between public <br />nuisances and property maintenance criteria and the affiliated methods for compliance. <br />Ms. Sandra Smith, Development Services Manager, reviewed the information provided in her memorandum <br />dated December 7, 2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the <br />Community Development Department). Ms. Smith provided a PowerPoint presentation (a copy is attached and made <br />a part of the minutes). Ms. Smith reviewed the changes that she and the City Attorney made to the verbiage <br />regarding outdoor /open air storage. <br />
