Ms. Smith explained <br />that these code changes are tools that can be used to assist with enforcement. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />A general discussion ensued regarding the proposed code revisions and the enforcement of play structures <br />in the front yard. Mr. Parkhurst expressed a concern with the proposed code revisions. He felt that the City was <br />becoming a homeowners' association. Ms. Smith said that the Code Enforcement Officers do not enforce every <br />code; however when it becomes a problem the Code is used to ensure that the violation does not continue on a <br />particular property. She said staff is not selective and enforces the same code in the same manner across the board. <br />Ms. Smith explained that the Codes are being written to maintain and uplift our residential communities. <br />Ms. Smith explained that the Code Enforcement Officers had been overlooking certain items in the past that <br />have added to the devaluing of the residential areas and were not addressing those issues. She said that some of <br />the enforcement is based on the current public nuisance ordinance which includes some aesthetic items that she <br />didn't feel comfortable using because a public nuisance deals with health, safety and welfare issues. Ms. Smith said <br />she is trying to remove the aesthetics from the public nuisance portion of the Code. She said the proposed code <br />changes deal with maintenance standards. <br />In response to the Commission's question, Ms. Smith reviewed the jurisdictional survey regarding outdoor <br />storage. Mr. Bakalla questioned the use of the word "uncultivated vegetation" that is used in the Seminole County <br />Code and the reference to "vegetation" used in the City's Ordinance. Ms. Smith said she did not know why Seminole <br />County used the term "uncultivated vegetation ". A general discussion ensued regarding excessive growth and the <br />Code Enforcement Board serving also as the Nuisance Abatement Board, <br />Mr. Parkhurst asked for a motion to address LPA 11 -13. Mr. Meadows made a motion to provide a <br />favorable recommendation to the City Commission for LPA 11 -13 to amend the City of Casselberry Code of <br />
