All plant materials must be in a healthy, living state or removal and replacement per Code will be <br />required. <br />5. The site lighting and photometric plan must pass inspection prior to issuance of a Certificate of <br />Occupancy, <br />6. All Public Works issues must be addressed prior to issuance of a site construction permit. <br />7. Two handicapped spaces must be provided on -site according to ADA standards. A plan must be <br />submitted to staff for approval. <br />8. All conditions must be fully executed or the site plan becomes null and void. <br />9. The site plan is valid for one year. Failure to obtain a building permit within one year will result in the <br />expiration of the site plan approval. <br />Mr. Meadows asked the applicant to come forward. Mr. John Herbert, American Civil Engineering, 207 <br />North Moss Road, Winter Springs, Florida came forward. Mr. Herbert stated that he concurs with staffs <br />recommendations and he is available to answer any questions. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br />Casselberry suggested adding a painted crosswalk on Lemon Lane. <br />Mr. Meadows asked for a motion to address SPR 12 -19. Mr. Wadley recommended that the Planning and <br />Zoning Commission approve SPR 12 -19, site plan for an overflow parking lot at the northeast intersection of Lemon <br />Lane and South US Highway 17 -92, based on the information provided in the staff report dated December 12, 2012, <br />the attached site plan dated November 29, 2012, the findings and conclusions, and the nine conditions (8 written in <br />the staff report and 1 presented at meeting). Mr. Bryan seconded the motion. The motion passed unanimously by <br />voice vote. <br />Seventh Item of Business: SPR 12.21: Newport Colony. Tree replacement waiver request for the property <br />located at 1166 Pointe Newport Terrace. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated December 12, <br />2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Ms. Regan provided a PowerPoint presentation (a copy is attached and made a part of the minutes). <br />Ms. Regan said staff finds that a reduction to the inch for inch replacement is not warranted as the site is <br />well treed. She said due to the landscape agreement for the site, staff would prefer to see trees replaced where <br />
