Planning & Zoning Commission/ <br />Local Planning Agency <br />October 10, 2012 <br />Page 7 <br />Tenth Item of Business: SPR 12 -16: Legacy Park Phase III. Major site plan review for the construction of fifty <br />(50) garden home units within the Legacy Park Planned Development, Tract C. This property is located <br />within the Seminola Boulevard Overlay District (SB -2). <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated October 10, <br />2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department), Ms. Regan provided a PowerPoint presentation (a copy is attached and made a part of the minutes). <br />Ms. Regan stated that the items that are highlighted in orange print in the PowerPoint presentation are items that <br />need clarification from the applicant. <br />Ms. Regan said that staff recommends that the Planning and Zoning Commission recommend approval to <br />the City Commission of the application SPR 12 -16, Legacy Park Phase III, within Tract G of the Legacy Park Planned <br />Development. She said the recommendation is based on the site plan dated September 19, 2012, the findings of fact <br />and conclusions of the information provided in the staff report dated October 10, 2012, and subject to the following <br />conditions: <br />1. The Planning and Zoning Commission's approval of the following requested modifications to: <br />a. ULDR Section 2 -7.26 to allow an 8' high fence /wall in lieu of the required 6' high fence /wall. <br />b. ULDR Section 2 -7,26 to allow two columns of the sign to be 7' 3" and 8' 3" in height in lieu of the <br />maximum 6' high requirement for monument signs. <br />2. Approval of SP 12 -04, replat of the site, <br />3. All outstanding comments included in this staff report must be addressed and provided on a revised site <br />plan, reviewed and approved by staff, prior to submittal to the City Commission. <br />4. Adherence to the executed voluntary commitment agreement. <br />5. All required local, regional, state and federal permits are obtained before commencement of <br />development. <br />6. A site construction permit will be issued by Public Works. The applicant is aware that all submitted site <br />and construction plans must undergo a Public Works review prior to permit issuance. <br />7. The property shall pass landscaping, irrigation, and photometric /lighting inspections prior to completion <br />of the project or issuance of a Certificate of Occupancy. <br />8. The site plan approval shall be valid for one year upon approval by the Planning and Zoning <br />Commission. An extension request may be submitted prior to the expiration of this approval. <br />9. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and <br />void. <br />Mr. Meadows asked the applicant to come forward. Mr. Tom Daly, Daly Design Group, 2301 Lucien Way, Suite <br />405, Maitland, Florida came forward. Mr. Daly stated that this project was brought before the Planning and Zoning <br />Commission in June. He said this is the final site plan that codifies all of the conditions placed on the property <br />through the PD zoning amendment. Mr. Daly said there are a few items that need to be addressed.
