All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. Mr. Meadows asked the applicant to come forward. The applicant was not present at the meeting. Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. There were no final comments. Mr. Meadows asked for a motion to address CU12 -12. Mr. Wadley moved that the Planning and Zoning Commission approve CU 12 -12 to allow the on -site consumption of beer and wine as allowed by the 2COP state license, in conjunction with the operation of a restaurant located at 1555 State Road 436 Suite 1001 and the recommendation is based on the findings of fact and conclusions of the staff report dated October 10, 2012, and the 10 conditions outlined in the staff report applied to this approval. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote. Eight Item of Business: CU 12 -13: 1271 SR 436 /The Crystal Ballroom. Conditional use to sell alcohol in a PMX -H zoning district. Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated October 10, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Ms. Regan provided a PowerPoint presentation (a copy is attached and made a part of the minutes). Ms. Regan said staff recommends approval with the following conditions of approval: 1. The conditional use shall be limited to the location of 1271 State Road 436 Suite 127. 2. All sales and consumption of alcoholic beverages shall be on -site and indoors. 3. Package sales of alcoholic beverages for off -site consumption are prohibited. 4. The hours of alcohol sales must be within business hours and shall comply with the hours set forth in Section 10 -2 of the City of Casselberry Code. 5. Any sale of alcohol within the boundaries of this property must adhere to Chapter 10 'Alcoholic Beverages' of the City of Casselberry Code and obtain the appropriate permits and licenses from required governmental bodies. 6.
